PP1 Reclaiming

Looking for some advice. I made a PPI claim to Santander a while ago and they rejected it at the first hurdle. They told me if I wanted to continue, to go to Ombudsman within six months. Although I feel I had a valid case, the rejection worked and put me off pursuing my claim further. Now the tide has turned I feel I should have carried on. A couple of years has gone by, can I continue now and do I write back to Santander or to the Ombudsman? Thank's.

Technically no. You only have 6 months to refer it to the FOS. After that you are timed out unless you have a good reason for the delay (which you do not) or you have significant new information (no indication of such in your post).

So, Santander are within their rights to refuse you access to the FOS and refer you to the original response. However, not all the banks are that good are matching new complaints with old ones. So, its possible that if you made a new complaint, they may not match it up.

  • Thank's for the advice. If I make a new claim as you suggest, can I re-use the paperwork I submitted last time, or do I need to rewrite everything? Any help or guidance is really appreciated.

You can use the old paperwork as long as none of it shows a complaint reference number from santander. You dont want to help them spot it as a repeat complaint.
