the problem is you have lost your 'innocent' purchaser defence as you admitted you knew it was on finance - but soudnsl iek you only foudn out after you had bought it.
forget the bike now, go for a s75 claim against the credit card company - they hsould take the money back off the trader so he will end up payingfor it one way or the other.0 -
when i sold a car privately - i had to make sure the finance was cleared 1st, with written proof before anyone would buy it.
was a bit of a pain getting the £££ together but noone would accept "i promise i am going to pay the finance company out of the money i get from you..."

i wouldn't have bought the damned thing if i knew about the finance before the purchase, it wasnt til i was leaving the shop that it was made aware to me!

Go and see the trader, or contact your credit card company.

its not fraud unless you can prove the guy lied, so hold your horses i would say.
i woudl be surprised if htis was invetsgated as fraud - not worth the Polices time.

Well it seems to me the general consensus here is the insurance company are correct and it is their property whereas trading standards are advising you on the basis you did not know about the finance on the vehicle. So telephone then back and tell them you did know about the finance and how this affects your rights.
Arguing now that you did not know about the finance on the vehicle when buying would be an uphill battle, considering the finance company have a signed declaration from you confirming you did know about the finance.0 -
just after this all kicked off, trading standards asked me to exp[lain what exactly happened on the day of the purchase. I went through it with them and they then advised me that the finance company would have to prove that i know about the finance BEFORE i purchased the bike, which i can honestly say I DIDNT. the keepers questionaire does not ask at which point i found out about it, they just ask did i know!!! at the time of filling in this form i did know, which i admitted, but failed to mention when i found out.0
