  • My bank (Barclays) has just sent me a letter saying they want to settle for just under the total amount required.

However, it also says "by accepting this offer, you also agree that the existence of the terms of this offer are confidential between us." - Meaning "you're not allowed to go on Tonight and tell everyone that we gave in."

I'm pondering over getting that removed, but not sure how.

Cross it out on the letter. Many people have done this and the banks have accepted they're in no position to make these demands.

Although unlikely, note they may withdraw their offer.
  • Have just spoken to a legal clerk at Barclays and explained that I wasn't comfortable with the terms (confidentiality & amount) and after a bit of 'negotiation', she accepted.
Thx to Nick & CAG website.

Look out Trevor, here I come!

  • Dear Martin,

Thank you for this excellent site, which is most helpful.

I have calculated the interest I can reclaim on the charges Abbey applied to my account - but your calculator insists on switching my day to the month and the month to the day, which changes the calculation and makes the list wrong.

    Can you help please?

    With thanks,

    Gimmick

The Interest Calculator is set to American style dates so provided each charge is input the same way the end answer will be correct. Have a read of this thread.

  • Hi Martin,

Wanted to share this recent scenario with you as we are quite staggered!

I have just started to process our claim against Natwest after failing to get anywhere with Natwest recently.

In December 2006 we were charged a staggering 500 pounds in charges for one month's blip in our finances! We approached our local Branch Manager who sympathised with us and told us that he agreed the charges were outrageuos but he had absolutely no authority to do anything about it. He explained that as a Branch Manager he has no authority to 'manage' customers accounts. We said that surely as a duty to customer care this amount was unacceptable and that they should of stopped the charges from occurring. He gave us a leaflet and told us to ring head office. We did and was then told to write and we may get a response within three months! Meanwhile we are 500 even deeper in debt.

Last Monday we received a call from our Landlords saying that our Rent had not been paid. Upon investigation with the bank they admitted to 'making an error' and forgot to pay it. (It was set up as a standing order). This was embarrassing for us as we are friends with our landlords. We are now playing catch up of an extra 200 pound a month, which we are going to struggle to afford, and I am distraught at how we have been treated lately by Natwest.

One positive aspect they gave us 150 pound in compensation, however have left us with a poor record with our landlord, arrears to catch up with over the next 6 months and I am very depressed and upset with the entire scenerio that has happened over the last couple of months.

Where has the customer care gone from our Banks? What's the point in having a local manager is they cannot do anything to eliminate the charges and control situations like ours?

I've written for a list of our charges over the last 6 years and I'm sure if December is anything to go by this will be a large claim. I know this will make me even more depressed and angry especially if I have to go all the way to court to get the money back but I am prepared to do it.

Thanks for reading this thread and I will keep you informed of my progress.
