Thank you all who have posted on here and following your advise I will do nothing[hope my nerve holds!!!] Does anybody know of Parking eye actually taking somebody to court and if they did is it ok to just pay the penalty notice before the court hearing.

In general PE do not do court. There is only one recent case we know about, that of PE vs Smithy. Read all about it here:

In essence, all they got was 2 x daily normal parking fee + 2 x DVLA fee, a total of £15 (their actual losses), plus a small amount towards costs, and not the £4000 odd that they claimed for, and note, NOT the PCN charge initially claimed. If he'd offered to pay the £15 at the start, they'd have got nothing else, it's only because he didn't that the case was found against him. Some say even this is unfair, as he offered to pay £10 at an arbitration session before it went to court. Most see this case as actually a LOSS for PE - even though they kindof won, they got pretty well nothing, and a lot less than it cost them.
If your invoice is for a free car park, then their losses are zero, and they cannot claim any more than that from you.
In conclusion, the best advice is still to ignore, and keep your nerve. In the extremely unlikely event that court papers are served, and that really is highly improbable, then the folk over at pepipoo can help defend.

PE were incompetent enough to threaten me with court action in the wrong country, the last time I had any dealings with them.

if the charge is based on their dodgy cameras, there is a whole raft of material on ParkingEye screw ups available. ParkingEye could never use their Automatic Number Plate Recognition system data in court because it has been shown repeatedly to be unreliable. I have dared them on several occasions to take me to court but they declined.Still waiting for Parking Eye to send the court summons! Make my day!0

Parking Cry have never taken anyone to court ever, they admitted on the Sunday Times recently that they have no intention of doing so either, so just ignore the scammers!Excel Parking, MET Parking, Combined Parking Solutions, VP Parking Solutions, ANPR PC Ltd, & Roxburghe Debt Collectors. What do they all have in common?
They are all or have been suspended from accessing the DVLA database for gross misconduct!

Parking Eye have done Court twice now it seems, 'apparently' won one but there was doubt about the behaviour in Court of the defendant and whether he was a put-up job, a patsy for the parking co. Then there was the Smithy case mentioned above who got help from here.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Believe me, I have a folder full of joke invoices from ParkingEye. Nothing has happened apart from me getting a few good laughs. I keep the Mickey Mouse 'fines' to show others that they can be ignored with inpunity. Have a worry-free Christmas.Still waiting for Parking Eye to send the court summons! Make my day!0

PE will not do court. This I can promise since I have had many invoices from them dating from October 2010 to possibly December 23 this year (if they register me having parked all day at a car park they manage).
The OP's concern is not so much whether it go to court but how to defend himself if it did. The principles here are that Parking Spy issue their invoices to the keeper and have no clue as to the identity of the driver, the second is that their demand exceeds losses. Provided the OP stand strong in court, respect the judge and remain polite, he can win this hands down.
But Parking Spy know this and that's why they won't even try court.0
