Online Order one year ago now require payment!

Hi
Last year I ordered coffee direct online with Nespresso. I recieved a letter this week to say they didn't take payment at the time and now require this within 5 days. I have placed other orders with this company since. I wonder if I am obliged to pay for there mistake?

You're not paying for their mistake, you're paying for your coffee. Why wouldn't you be required to pay?

But first check back through your statements to check that you haven't actually already paid. If you haven't then pay up - if you have then email them to deny the debt and provide proof of payment.0

However, given the time of year and the fact many people will be short of cash due to Christmas, I would consider payment in 5 days to fix their mistake to be utterly unreasonable.
If you do have an issue getting the money at this time of year, contact them to state this rather than just ignoring it.0 -
That's a fair point. I don't think they can demand payment in 5 days if they have waited a year to send an invoice. I would quite happily treat this as a standard Net 30 contract (but email them to tell them so).0

I agree, 5 days is a little bit on the ridiculous side at this point of the year!
If your having problems op paying it or need more time, offer them payment on or by a certain date or across two payments? Just show committment to pay the outstanding amount as it may well just be them panicking that they have forgot to bill you.0 -
Yes 5 days is just daft. as really rather than you not paying them, they are the ones who forgot to charge you, so to tell you to pay in 5 days for their year old mistake is not on, especially when you say you have made and paid for orders since then.0

I think the time of year is irrelevant - I think the fact they took a year to charge you is more important in negotiating how long you have to pay it back.

So if the OP were owed money by the company would you advise them to give the company more time to pay because its christmas?
The debt is not 5 days old is a year..... If the OP had disputed getting the goods then its time to not pay. If they got the goods they have to pay.
The OP agreed to buy goods for x price. Just because payment wasnt taken at the time of sale it does not mean they got it for free. The ammount is still due.
If i had borrowed a tenner from you and you took a year to ask for it back, would you allow me time to pay. of course not. its hardly your fault i hadnt payed what i owed you before is it.0
