Distance Selling Regualtions & Tickets?

I recently purchased four tickets for the 21st Jan for an event running at a popular London venue. The purchase was made via the venues website and paid for using a VISA Debit card.

No booking confirmation was received via email or otherwise.

On the 22nd December said tickets arrived 1st Class (post marked 12th Dec) and dated for the performance on the 21st December?!

I have spoken to the booking office for the venue and they have told me that "due to the show being settled with (SHOW NAME) we are unable to make a simple exchange" and have passed it the promoter to make a decision?!

What rights do I have under Distance Selling Regs and regs covering ticket sales?

Any advice you can offer will be greatly received as these were due to be a Christmas present for my parents and being £140 out of pocket and no present is going to really really stick in the throat.

    Did you not check when you didn't receive a booking confirmation ? I think you'll have to be able to prove that you didn't book for December. Without that i think you're stuffed really. DSR's don't cover tickets. Hopefully the promoter will agree to an exchange for you.

    I'm not an expert, but disregarding the fact that the tickets are for a date other than the OP thought they had booked for, surely there is still the issue of the tickets not arriving until the day after the performance ? Was the OP given a choice of how the tickets could be sent ? At this time of year post takes longer than usual, so I think you could argue that the ticket agency should have taken extra steps when sending the tickets to ensure that they arrived in time, or suggested that given the short timescale, that the tickets be picked up at the box office on the night ...

    I would agree, apart from that he has no proof that he only received them on the 22nd. In fact, if I was more of a cynic, I would query whether this was true - post may be slower at this time of year, but ten days seems a little excessive.

    In summary, the OP needs to prove:

    1. That he booked the January date.
    2. That he did not receive them until the date of the December show.

    I'd say that is going to be difficult.
