Consumer Rights Advice Needed

Hello to all. This is my first post. I recently (27 Jan) ordered 2 items on the Argos website and was told that the expected delivery would be 14 days. I have subsequently received a letter stating that the goods will not be in the warehouse until the 5th Mar.
Argos have already taken the full costs of the goods (over £300) from my bank account. I seem to remember something along the lines that a company was not allowed to debit your card/account unless they have the goods in stock. Can anyone confirm if this is the case, or whether Argos is within their rights to charge my card at the time of transaction despite the fact that the goods will not arrive until 7 weeks after the transaction.

There's no legislation to stop them taking the money at the time the contract was entered into.

As you have ordered it on the website, however, under the Distance Selling Regulations Argos should "perform the contract" (i.e. deliver the goods) within 30 days unless a different date has been agreed with you.

If they can't deliver by this time you can hold them in breach of contract and ask them to refund you in full if you so wish.

Furthermore - you do not have to agree to any change. If you are unhappy, ask for your money back. They will have messup up on the regulations anyway (hardly any company follows them properly) which will give you rights of cancellation.
