Bought Kindle on ebay.Resold and buyer say it is blacklisted

Hi,
I bought a Kindle on ebay 2 months ago. It was listed as 3g and new(other). The seller said it had just been opened and tested.
I received it but it had scuffs on it and was clearly used. It was also wifi only with NO 3G. The idiot also wrote my name in massive pen all over the box etc which made it impossible to give as a new gift. The firmware version was about a year old too. I therefore raised a dispute.
The seller seemed to be talking bs but did not want a negative. He then told me that he was selling it for a friend but offered me a partial discount which I took as it appeared to be easier to just relist it accurately. It took him about 2 weeks before he finally refunded a bit. I therefore closed the dispute.
I have finally got around to selling it but the buyer has just told me that it is blacklisted by Amazon as reported stolen in January.
Now I am guessing that I am up the creek without a paddle here.
Is there anything that I can do? I am assuming that I could perhaps contact the person that I bought from and tell them that it is stolen . tell them that I will raise another dispute etc? (the person only buys not sells so I dont know if that will work).
It never dawned on me to check that the kindle has not been stolen.

I have just read another thread on a different site.
Suggestions include:
contacting paypal / credit card company as I have bought stolen goods.
small claims court against seller.
Good ideas ?

You can't do any sort of claim through ebay or paypal for this as you are out of time.
However you do still have the option of small claims court but only if you cna get a precise geogrpahic address for the original seller.
