just my luck, the people I want to exchange with won't wait that long, guess I may aswell just give up now as been getting my hopes up which I shouldn't have.

Normally your rent has to be clear of arrears for 6 months before the council will be letting you exchange homes.
Not true. The grounds for the council refusing an exchange are set in law - and this does not include 'rent arrears within the past 6 months'. See my earlier post for a link to the legislation.0 -
Hi Squinty many thanks for all your advice, I cklicked the link however please could you help me, I don't understand if having a adjourned court order means I have a court order against me, I asked the lady I am exchanging with to ring the council to see if they will accept me but all they could say is each case is different and its at the councils discretion whether they want to take me on, she did say that they said if I write a letter explaining why I was in arrears ans that the house will be much more managable for me then that may help?? Just sooooo worried I will get refused, I just want to pack now but I am in limbo

If the case was adjourned no court order is made.
However, you need to check. If the court made a suspended order, or postponed order there is a court order. You would normally recieve something from the court to confirm this.
Your best bet is to specifically ask the housing officer what order, if any, they have - some may use the terms as if they were interchangable - they are not.
You also need to understand how your landlord deals with court costs - if they exist have these been added to your rent account, or are they in a different account? These will also need to be cleared.0 -

My housing officer said this in an email -
you are subject to an adjourned Order of the Court to make payments
so I am hoping this means I am not under a court order, not sure about the costs think there was 100 added to my rent account?? so do you think I stand a good chance?
