Online purchase from abroad counterfeit what are my rights

I purchased a north face jacket online - i thought i was buying from american - turns out its come from china. So far any queries ive had with the delivery have been replied to promptly, the item is due to arrive tomorrow, i am however getting rather concerned that the jacket may turn out to be counterfeit as when i looked at the returns policy - it only talks about replica ugg boots - despite the website only selling north face jackets). I guess my question is that am i able to do anything about this? I paid with a visa debit card. Can I claim for a charge back with my bank?

The jacket is from a previous seasons range, and it wasnt much cheaper than it would have been new, i just couldnt find one in the uk as its from past seasons collection. Had i realised it may well be fake i would have purchased a similar one from the uk.

Any advice greatly appreciated as i think i have been miss sold.

    PS i now feel like a complete idiot - knew to stay clear of items that seem to good to be true but this wasnt much cheaper!
  • If the jacket turns out to be fake then I would take it up with your credit card company. They are your best advocate for settling disputes with merchants. If the jacket never arrives then I would look into reporting it as a fraudulent purchase and ask them to cancel the transaction.

    look at the article regarding visa chargebacks - if no kuck fro mthem then you are stuffed if the shop dont wnat to play ball.

    It can't be reported as fraudulent as the OP has ordered and paid for the jacket. You can't cancel a card payment.
    If it doesnt come, your card issuer can action a chargeback for non receipt of goods. If it's counterfeit, they need to speak the the card issuer, some will take this up for you, some won't. The difficulty they will have is proving that the goods were sold as genuine.
  • Your only hope is with the card issuer agreeing with you that the goods supplied do not conform to the contract, as they are counterfeit. Your chances of getting any money back directly from the vendor in China are about the same as I have of winning the lottery this weekend.

    Were do you think North Face jackets are made? You haven't even received it yet and you are getting your knickers in a twist. Hope you have the VAT money and clearance fees set aside too!
  • Last year I bought some Nike Air Max 1 trainers from a genuine looking website, it wasn't until they arrived that I realised they were obviously fake. I sent them an email letting them know that I ws unhappy and if they didn;t refund me immediately I would be contacting Nike and let them know what was happening. They refunded very promptly thank god. I then contacted Nike anyway and the website was gone a week later but probably operating under a new name.

    Try my approach and then let The North Face know anyway.
