separated from husband

Hi, I wondered if any1 would be able to help, i have searched but cant find anything.

My husband and i have recently split up and he has gone and got a credit card, and has not changed his addressfor his bank account, so his credit card is registered to our martial address.

If he runs up this credit card and then does not pay it off, am I liable for the money and can he get the house blacklisted.

Any help would be greatly appreciated.

    it'll be his debt and a house cannot be blacklisted but if you have any joint financial commitments then you will be linked to him and he can still trash your credit rating.

    Check your credit report and see if you are linked at all.
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.
  • The only thing in joint names is our morgage, which he has not helped with since he left, I checked my credit report and his name does come up as he tied in with the house. So can he still ruin my credit rating, nothing else is in joint names thou just the mortgage.

    Unfortunately you cannot sever the financial tie until your mortgage is settled, even now you are seperated and no longer live together.
  • you are not liable nor will your house be "blacklisted"

    until you are financially disassociated from him his credit rating will affect yours though so try to get everything sorted out ASAP.

    any letters just return to sender.

    So he can run up debt and cause of the mortgage I will be liable for it.He has some serious problems, so i can see this being a big problem. Not good .

    Just seen the previous reply, from adamantine - thank you. I have got an appt with CAB after christmas. I cant get him off mortgage but am trying to sort things out, but he is not helping. Its such an uphill struggle at the moment .

    The credit card is in HIS name - so he is liable not you! any letters addressed to him can be returned to sender - though you can, if you wish, use a larger envelope and include a note saying that he no longer lives at the address given, and give them his current address if you know it!

    If this isnt a 'legal' separation - then do something about that now!

    have you closed all joint accounts bar the mortgage? how about gas, phone, leccy...? are they all in your name if you remain in the marital home?

    No, this isn't what has been said. Only he will beliable for debt run up in his name. But your credit rating may get affected because you are linked through the mortgage. Suggest you get an appointment with an IFA/mortgage broker to see if you will be able to take on mortgage in your own name (if he agrees). IFA's can make a good case for you with mortgage company's if your credit rating is purely affected by actions of your ex after you have legally separated.

  • Thank you so much for the advice everybody, i am slowly understanding. I have made an appt with CAB and then will follow up with solicitors, its not a legal separation but will find out how to put that in place, I am entitled to legal aid, as i only work part time so that will help with expenses.

    I am lucky as the mortgage is low as we brought house ten years ago, so i am still able to pay it.

    We have never had a joint account, and all bills are now in my name, its just joint names on mortgage .
