Company have not paid me my Maternity Pay

I started Maternity Leave on Monday and I get 90% of average salary for 6 weeks then SMP. I normally get paid at the end of the month but because of the Christmas Holidays I'll get paid tomorrow. I recieved my wage slip today and have been paid a normal months money. Which is about £300 short of what I should have been paid because during the 8 weeks average salary I recieved a bonus. I've spoken to the wages dept and they tell me it's because my HR dept hadn't forwarded the paper work to them they tried to say that they would sort it out in the new year, but I've told them that this is not good enough.

Does anyone know legally where do I stand? I think its terrible telling me I'll have to wait until January for money that I'm legally entitled to.

Any advice would be greatly appreciated.

    Being this close to the end of the year and with people being on holiday I dont know how easy it will be to get things resolved quickly?

    It really depends how they make the payment to you. Im not up on payment methods etc so I cant help sorry :(

    I am sure that they cant withhold wages if they have made a mistake and there are definately ways that they can same day trf the money to you! I would keep pushing for it, I'm sure they wouldnt be so relaxed if it were them!

    Like anything else, if you suffer a loss as a result of somebody else failing to honour their side of a contract you can look to them to make your losses good.

    So, in theory, you could claim the interest you lose on the money or the cost of borrowing the money for however long it is outstanding. You would have a duty to keep your losses as low as possible. For example temporally withdrawing savings if this is cheaper than an overdraft.

    Having said all that, in the real world is it worth falling out over a couple of weeks interest on three hundred quid?

    It's not the interest that bothers me, its just the fact that I'm going to be £300 short in my wages at a time when I really need the money.
  • You need to get on the phone tomorrow and ask how you can resolve this in order to get a payment this week. Don't blame anyone, just ask for instructions on a resolution.

    It might mean you offering to go to HR's office, and walking the paperwork to the Payroll office, so that it can be sorted.

    But your actual loss is the cost of borrowing the £300 for however long they keep you waiting if you don't have this amount in savings.

    That is the maximum you could claim off them.

    I think what the OP is saying is that she just wants her £300, she isnt bothered about claiming for losses etc.

    As a pp said, I would ring them and be very resonable and say that you hav ebeen underpaid and would like the money before christmas. Is there anything I can do my end to assist you in doing this etc etc....

    i would be really stressed losing £300 of expected money just before christmas.
  • Ask for them to send you a cheque for the money to your workplace asap.
    Its not the quickest way to get the money in your bank but at least you will have it, as i doubt they will want to arrange a bank transfer just before christmas.

    I would have thought that if you only started maternity leave on Monday then the payroll would have already have been processed for that month using data pulled prior to you commencing maternity leave. Personally I would have been very surprised to have been paid my maternity pay this month?

    Thanks for the helpful replies.

    The wages are now done from a different office which is 150 miles away from me so going there would not be a option and sending the money to my office would not be a option as it's 130 miles away. I recieved written conformation from them 15 weeks ago stating when my Maternity Pay will start and when I'll be paid it.
    Googlewhacker it is pay that I'm entitled to whilst on Maternity Leave and it's the Goverment that set the rates not me or my company. So saying I may have to wait until January can not be legal. I certainly will kick up a fuss until it's sorted.

    I'm just hoping that they can sort it and do a Bacs payment tomorrow
