You need to understand the difference between applying for a residential mortgage with the intention of letting the property and moving out of a property and renting it out when you legally obtained the mortgage for you to live in the property as your home.
One is fraud, obtaining money by deception and one is a breech of a terms of your mortgage.
You need to understand deception and such like were replaced in 2006 by the new fraud act. Much has gone, some replaced and some new offences which were originally in the theft act.Ignore Brit1234... he is full of !!!!! and he is a rookie police officer. Knows shte about the law and certainly nothing aout the housing market. He predicted a houising crash in 2009 whereby houses will cost 50% less.
Arrest & prison time for not informing your mortgage provider that you have rented your own property for just a year. Police are going down that route!!!! because they have failed to deliver real policing whcih is all about making our streets safer.

No I am not aware of repossessions. However I am aware of plenty of arrests, prison time and big fines. Police are more and more going down this route. Often people have to sell their properties afterwards anyway.

On top of that if your flat got burnt down or trashed you could also be exposed and lose a lot.
Always do the right thing.
Can you give us just one example of an arrest, prison time or big fine because of someone renting their flat without CTL.
The OP's situation has changed there is no fraud involved, whether the OP gets CTL or not is a civil matter between them and the bank.

In future -after I have paid off my 50% SO I will be posting here for advice on planning & buying my next property. I will be glad that you will not be contributing.
How does missing the odd letter makes me a bad speller? I use a samsung S11 to contribute to this forum so what if I miss rhe odd letter or hit the wrong key.

Do you not think that the amount of database cross referencing that goes on would flag you up?
In your theoretical situation where would your post be going, where would you be registered for C Tax, utility bills, signed up to the electoral register and so on?
Guess you'd also avoid declaring the presence of a paying T to your insurance company and the rental income to HMRC.........0 -
I have friends who rent the property without telling the mortgage company. Its to a fellow employee which they are good friends with. It just takes one phone call to the mortgage lender to drop them the hint, then back-dated fee's will follow.
We have our consent to let, it was for a 3 year period which runs out next year. We were allowed this free of charge due to our employment, though we did receive a letter telling us that they would normally increase the mortgage by 1%. This would of taken ours up to over 7.0% as we fixed for 5 years.
Luckily enough, our mortgage is that low that we overpay the maximum each month so we are far far ahead of the drag curve. So what happens when we need another consent to let? I would call for it early, though with the overpayments going through i cannot see why we are not good customers.
If they compain, we shall just dump our savings into the mortgage, take a small bank loan <£5k and pay the damn thing off. The interest & charges could be paid from the rental income0 -

Not telling your bank that you are letting your property for a year is not a crime. You are committing no criminal offence - It is purely a breach of the terms of your mortgage.
They can only ask you to pay back the interest or simply move on. You guys are making this out to be the crime of the century.
Now an increase of 1% or a small fee upfront is reasonable. Like the Alais I know a few people who have let out their properties without informing their mortgage provider. One of them has done so for the past 15 years without them knowing. I know it is wrong to rent your property without consent but when the only option is to pay extortionate interest rate I will definitely not tell them.
The extra charges should be consistent and reasonable and consent should be given on a short term basis – maybe for a year or two.
I think banks should give temporal assistance to families who have to move away from their main residence in search of work. It is not always easy to sell your home within the time someone is offered a job and his/her start date.
During these hard times people will have to look for work away from where they live. Running two homes or paying extortionate mortgage rates is not possible for most families.
The problem with this country is that we never stand up and fight against what is clearly wrong practices. We tend to moan about it and many years later some government body will decide to rule on the matter and it makes the headlines
These things are no brainers – take today’s headline news ‘credit card surcharges’ and there was the excessive bank charges when you overdraw on your account. These should have be fought when they first started and not so ten years down the line.
Why do we let businesses especially financial institutions cheat us off our hard earned wages and get away with it? Yet when we try to do something about it the so call do-gooders jump on our backs accusing us of being criminals

Agree wholeheartedly HARSA. It's the lack of reasonableness and apparent inability to take individual circumstances into account that's so galling. The ironic thing is, as part of her rather officious lecture, the Halifax employee said that those who do not declare they are leasing 'always get found out' (I also have friends that certainly haven't been) and when they are the Halifax immediately increases their rate by 1.5% as a penalty. This would still be significantly less than the rate they propose to charge us for consent to lease! Hardly a deterrent.0
