Problem with Swinton insurance credit agreement

I recently took out home insurance with Swinton insurance. I took out the insurance through the moneysupermarket the middle of October and I received my policy documents on the 16th November.
Inside the policy document was a credit agreement which was stated that I had to sign and return within 14 days of the date on the letter, otherwise I would be charged an admin fee of £25
However the letter was dated the 31st of October, so the 14 day deadline had already passed before I received the letter. The post stamp on the actual envelope that the policy documents came in was dated the 7th of November. So Swinton either sat on the letter for a week before posting it, or they backdated the date on the letter to a week earlier.
I phoned up Swinton straight away when I noticed this and they said that they would put a note on the file and that I would not be charged. I even wrote on the back of the credit agreement that I had not received the letter until the 16th of November and that was why it was late.
I checked my bank statement today and they have charged me the £25. I have tried calling them today but I cannot get through.
I am going to send an email to them later, but where do I stand with this? Can i threaten them with the small claims court? I still have the letter which is dated the 31st of October and the envelope which is dated the 7th of November, so I have proof that something strange has happened.

    Give them chance to rectify it.
    Bit early to be threatening them with court :eek:
    I like Swinton as they are on the High Street and I can just pop in to sort queries out. I have phoned them, and e mailed them about policies and changes to them and I haven't had a problem so may be worth another call later.
