Car insurers got details wrong

Hi please could anyone advise me as to where we go from here. My 20 year old son bought his first car insurance in September - paid £500 up front and then 210 a month. He registered over the phone with the reputable company? and after phoning them five times, going through security etc we received motor insurance document.
He then rang to change his DD date last week. He went through security and then - wait 'we have your wrong date of birth down' he was suddenly 10 years older.
After ringing them 7 times they suddenly tell us your details are wrong but after an hours wait they contacted us to say that they had listened to all our phone calls and the fault was with them. Policy automatically cancelled they took additional £35 out of his account (wanted to take £500 first) and then ?????????
Complained to the bank we went through last week and then rang them today as my son needs to insure his car for work but due to the high premiums due to his age he needs to pay a further £300 initially to another insurers.
As the policy was null and void due to their incompetence should he get his premiums back and where can I go to take this further as his job is at risk due to him now not driving.
This has ruined Christmas as nobody is in a rush to help resolve this so please could anyone advise

    He needs to get this sorted with the original insurer as he will have problems getting any type of insurance elsewhere as he will have to declare that he has had insurance cancelled.

    I would ask for a copy of these calls they owe to be sent to you ASAP and if they could point out which section the refer to it would be helpful.

  • Hi I can't get anywhere by phone but the call centre. They are aware of the complaint being sent via the bank (LLoyds) but say it takes a few days for it to be investigated. They have verbally admitted liability both to myself and the bank but I'm really frustrated as they have said that if I return the certificate of insurance they will refund my son £250 - he's paid out almost £1000 and their argument this afternoon was 'well we covered him initially and if he'd had an accident we would have taken the blame for the discrepancy on his insurance' :mad: were do I go for a quick legal solution if I can't ring the correct department and I now have to insure it to stand on my drive?

    Is the car insured elsewhere at the moment? It's now a criminal offence to have an uninsured car if it hasn't been declared sorn.

    No it is not, it is a legislative penalty charge, you wont get a criminal record by not declaring sorn for the reason that they wont have "summary justice" tested in court on the human rights act, "no punishment without crime"
    So all you will receive is a civil penalty, which as ruled by the court of appeal is not a fine.
    It only becomes a "criminal" offence to make a false declaration, as this is a crime, so they could stand for it to be tested in court.
    Penalties are summary justice and banned by international, law and human rights act and magna carter , but in this country we will stand for coal breaking on our heads, so they dont care.

    Who cares if it is a criminal offence or not...the advice about declaring SORN was good advice and the OP doesn't need to know about taking DVLA to court and would not want to be hit with a fine for no insurance.
    If you want to rant about this, start your own thread, it is a little off topic here. (I know you were commenting about the quoted text included in your post, but it is not relevant to the OP's topic)

    Yes it is slightly off topic but for the sake of anyone reading this thread the inaccuracy must be corrected.

    Actually, it is a criminal offence. Section 144A Road Traffic Act 1988, introduced by s.22 Road Safety Act 2006 and implemented on 4 Feb 2011 by virtue of the Commencement No 6 Order S.I. 2011/19.

    S.144A(1)
    "If a motor vehicle registered under the Vehicle Excise and Registration Act 1994 does not meet the insurance requirements, the person in whose name the vehicle is registered is guilty of an offence."

    Is the term Null and Void the same as cancellation,

    I think in the context this is, it isnt really a cancellation in the full sense of the word. Its not like cancellation for non disclosure or non payment, just my thoughts.
