redundancy pay question

Hi there - we've been given a pre-consultation proposal on re-structuring our dept (they say we are about to go into 90 days consultation but then are not doing anything about it!).

The job I do at present will go and it is unlikely that I will get any others on offer and will be looking at redundancy. At the moment, my childcare is paid through salary sacrifice and as such, I need to come out of this at some point so that my redundancy pay is based on my full salary, rather than the "salary minus childcare". I wonder if anyone knows at what point I should do this - is redundancy based on the salary at the start of the official consultation (in which case i need to do something now) or on your salary on your last day at work (in which case I can wait and come out later is i'm on a 3 month notice period).

I'd be grateful for some advice

    Statutory redundancy pay is based on your gross weekly salary on your termination date, or, if there are significant variations, on the average of the last 12 weeks pay. There is a maximum of £400 pw (rising to £430 in February).

    You may however have a different contractual arrangement so you should check with your employer if that is the case.

    thank you for your quick reply - i guess i'm relatively lucky (?) in that I'm in the public sector and we get enhanced redundancy payments but i'm not sure whether they calculate payment on the wages on your last day. I know that if I don't come out of salary sacrifice at all, it has an impact on the final salary but not what happens if i stay in for a while and come out the month before i'm likely to leave. One of the difficulties is that the HR manager is not in and the other advisors don't seem to know the answers to the question!
