employers responsibilities ?

In December the MD of the company I work for was giving a speech infront all all the employees when he casually mentioned that part of the company was moving to Germany. He did this as though he was making a shopping list. When people questioned it he said that an announcement would be made in January. The company has never tried to keep it a secret that there may be redundancies. They keep stating they will make an announcement in January. I have now heard froma reliable source that this side of the business will be lost by the UK in May/June time.

Since this announcement they have been employing staff (in the part of the business that is staying). They have advertised the jobs externally but not told anyone internally.

What are my employers responsibilities for its current employers?

    Their responsibilities are to conduct themselves within the law which means annoucing potential redundancies once firm decisions have been taken, consulting individually and/or collectively as appropriate, considering people for suitable alternative employment if there is any, selecting people for redundancy in a fair and reasonable way, and giving people their correct contractual notice and redundancy pay.

    Although I am sure correct, this does not actually help the OP.

    eg. from the posts it looks as though the company have already made their decision but have not yet formally told the employees.

    In the meantime, another part of the business is recruiting external candidates.

    I am sure that the OP and their colleagues would like to apply for one of these jobs.

    Not sure what that adds to anything either.

    If they haven't formally announced their decision/informed those staff who are at risk, then legally nothing has happened yet. Once it is announced, they have to ensure that anyone at risk is offered any suitable alternative roles.

    About the only thing you can do is start asking the questions that will come up once formal consultation starts.

    Why are you keeping the move plans so secret
    Since you plan to close this outfit in June and move it to germany what will the relocation packages be would love to move to Germany.

    What are the redundancy packags going to be for those that don't want to relocate?

    Also start saving holiday.

    How many people? might be worth looking at union or setting up employee reps now so they can be a conduit for questions.

    Look for the signs, these things take planning and usualy some transfer of skills.

    There is nothing stopping the OP applying for these jobs along with external candidiates.
    I myself am made entirely of flaws, stitched together with good intentions...
