    HOW..I hope the other policyholders can position their cases in a way that falls within the FOS terms of reference, because regarding the premium increases it appears that Aviva have successfully boxed the Ombudsman into his narrow remit and entirely removed him from the process by claiming "commercial" factors.

    Heathcote is right. This was always going to be an FCA issue given Aviva's size and influence. The only course now is the FCA.

    If they do not respond (and heaven knows they have enough on their plate) we are sunk.

    At that point it becomes a political issue, and as we all know that requires lobbying.

    So those that can do so (lobby their MPs) had better get started, or Aviva will have won and a huge injustice will have occurred.
  • The views mwng presents are well intended but deal with part of 1 dimension, whereas there are at least 2 other dimensions to this terrible situation that Aviva has unfairly created for policyholders.

    As for the FCA it is already aware of issues and at a much higher level than the team supervising Aviva. The challenge is more about increasing their understanding rather than pillorying them with the same information. The same objective is relevant for FOS.

    Mwng must go in his direction and I wish him well.
    Others will continue with their work to obtain required remedies from FOS for Aviva’s disgraceful behaviour.

  • I reckon Aviva put the idea into FOS's mind when Mr D provided the opportunity.
  • Felt good as adjudicator no longer chasing acceptance of Aviva's offer.

    Then discovered he was on holiday!

    Well that's equally good news!!
  • FOS has dug in firmly on this.

    The Mr D decision was published on its web site some time ago - reference DRN9393922.

    Not totally bad news as FOS will need to blame any change on Aviva having misled it.

    As policyholders have been constantly misled by Aviva that might not be an impossibility!
  • Does seem an uphill battle but relying on Aviva misleading seems a reasonable bet.

    We will get first indication as adjudicator will again attempt to force us to accept Aviva's offer if Sakagawea submission doesn't convince him.

    Be interesting how this develops.
  • From all the emails whizzing between us all there's a large number
    saying the same thing.

    Let's hope justice prevails.
  • Do we know whether Aviva is still partying and having a laugh at a naive FOS?
