Can anyone help with my play.com problem

I ordered a dvd/cd on play.com on 23rd November 2011 as a Christmas present for my partner. On 19th December 2011 I recieved an email to say that my order has been cancelled as product is no longer available. When looking on the website the dvd/cd is still available but I have noticed that the price is now £34.99 when I ordered it was only £13.99 so I think that is why they have cancelled. I have sent 6 emails to them informing them how disgusted I am. I have had 1 reply basically saying that they are sorry but the item is not available and sorry for the inconvience. I have tried calling them 6 times also but after being on hold to an 0845 number for 10 minutes each time I give up. Does anybody no my rights with this? I dont think they should be allowed to take and order then 4 weeks later with only 5 days till Christmas basically say they cannot send it me and I will have a refund if money has been taken. I have now got to go searching for the dvd/cd to try and get in time for christmas. Somebody please help.

They cannot be forced to sell it you at the lower price. Get it elsewhere.0

Unfortunately contract is not formed until despatch. Even though they may have stock, if they don't have any of the stock that was offered at £13.99 then they are within their rights.
Crap way for them to respond though - they should have just admitted to a pricing error (if this was indeed the case). But the bottom line is that they are only obliged to refund your payment.0 -
They havent said it is the price increase it looks like that. So basically they can take an order and then 4 weeks later decide not to send it? So I have to be the one that has to search around looking for the item. There has to be a law somewhere that says they must post out within a certain amount of time unless informing you of a delay. I am the one that is now without the gift .0

It isnt about the price I would pay more for it. Its the inconvience of not telling me till 5 days before christmas and the not answering emails and phones.0

Have you checked whether the item you see at the higher price is being sold by Play.com or a 3rd party seller on PlayTrade? It wouldn't really help you, but it may be that they're telling you the truth when they say the product's no longer available from them, despite it being listed on their site at a higher price.
I bought an item from Play.com yesterday and after placing the order, I noticed them item was now out of stock with Play and was being sold for a higher price by another company.This is everybody's fault but mine.0 -

Thanks to everyone for your input. Just really annoying that a company can do things like that and make you wait so long before telling you. Guess I will just stick to Amazon never had a problem with them before.0
