Help with claiming off of people upstairs

Hi, my son is an invalid and lives in an adapted groung floor council flat, he was away for a week and when he arrived home last Tuesday he found all his kitchen ceiling on the floor and the floor was flooded, it turned out that the new private tenants that moved in upstairs 8 weeks ago had a new washing machine and it was fitted by Curry's and seems that every time they used the machine it was leaking under their floor until the ceiling came down.

When the ceiling came down it crushed my son's Robot Vaccume cleaner, that cleaner has been a godsend to him because he suffers with PPMS, my son does not have insurance, but the people upstaires have, can anyone advise how he can claim and who should he claim against. The coucil are dealing with all the other damage.

    He can only claim off the upstairs insurance if he can prove the people were negligent.

    If it happened over a time, did he not notice any damp patches on the ceiling

    It might be wise to get him to get some contents insurance in the future, It can be as little as £50 a year.

    £1 a week is little to pay for peace of mind.

    No he had not seen any damage before, when it happend he had been away for a week and found it when he arrived home 5am last tuesday, it seems that when their machine pumped out it mus have leaked so it was a gradual thing and took a long time to soak through the sound proofing until it reached the plaster board

    He needs to bill the people in the flat upstairs (give them a list of the damage to be rectified), then it's up to them whether they claim off their insurance or off Currys.
