Employment Tribunal - Date for Hearing

I've just received a letter saying my claim was accepted and they have set a date for the hearing.

What happens at the hearing? does anyone have any experience of these?

I am in touch with the CAB over this, but they are really busy so still waiting for a response.

If you have only just got the letter accepting the claim you are probably way off needing to worry about the hearing - it may never get that far! Many cases are settled through ACAS mediation - you should hear from them soon if you haven't already. But the process is rather informal - nothing like the court-rooms you see on TV so don't get yourself stressed about it.

Thanks SarEl, I'm hoping it doesn't get that far, but they have a tendency to ignore things like this and hope it will go away, I know, I used to open the post!

Its not for another 2 months.

I just wondered if anybody had been to one.

Thousands - would you like to pick one? :)

Seriously - if you are that worried they are public hearings - go sit in on one!

Not worried at all, just curious. Bit too far for me to go just to have a look see! Will wait and see what lady at CAB says, thanks :)

They really are very informal - sort of a court but friendly. You do all the swearing in and telling the truth bits, but there aren't gowns and wigs and so on (well, a couple of pretentious barristers will insist on wearing them, but I find the wig still itches and messes up my hair!). The language and process is kept simple and the judges will explain anything that you are confused about - although they can't help you with your case of course. Smaller claims may never even get that far. It may only be your side, the employers and a single judge in a room. But something like half the cases (I can't recall the exact statistics right now) never get that far.

OP, if they ignore their post then you may not have to go to it.

Our respondent hasn't replied to any of his letters so it looks like we will get awarded by default. :j

Hun I posted a v similar thread yesterday (think its on page 2), I got some good advice from Jarndyce.

My ET is in Feb and I am bricking it - even though my ex employers have admitted their mistakes. My solicitor got a call from ACAS two weeks ago saying they had rejected my settlement offer, then we got the court date.

I really hope they settle out of court - I don't know much about the process but I think they would look a bit silly at a hearing when they've admitted everything?x

Good luck and keep us updated x

This is a bit different - yours was where a claim had been conceded by the respondent and you were awaiting a remedies hearing (ie to set how much compensation you would get) IIRC - this one has only just been listed for a full hearing, so no liability has been conceded in this case.
  • Thanks everyone for your replies, I will let you know what happens! :)
