Buyer "presumes" colour then complains its not colour she thought and wants refund??

    I think this only applies to buy it now listings. Auctions are not covered in the same way. Sure auctions are pretty much sold as seen in the same way as if you went and bought a car at one but online you are trusting the listing.
    However unfortunately feedback is far more of a factor and if its not a stupid amount of money i'd just accept it.

    In this case because the buyer has admitted she thought it was a colour which clearly isn't what was described in the listing then you should be ok unless there is anything in your listing that could be misleading. If for instance you used a picture which showed the colour she wanted or there was some reference within you listing that could be misinterpreted.

    It does only apply to BIN, unless I missed it the OP hasn't stipulated how they sold the item.

    If the item is genuinely NAD then it doesn't matter whether business or private, auction or BIN. If the buyer has not received what is stipulated in the listing they are always entitled to a refund.

    We ar etalking ebay and paypal here so all buyer has to say is item was SNAD and they are around 99% likely to win the case. So knowing that it is sometimes better to accept a return rather than to force a buyer to open a dispute.

    The stock photo, as I mentioned earlier, makes it very likely that paypal will automatically find for the buyer.
