i've just got off the phone from Shelter and they said we should fill out an N244 form and get attached to the court proceedings? They said we should be able to get 2 month's notice, and there is a possibility we could rent from the bank until the flat is sold. So it looks like this is what we will do....

Whether your payments cover the mortgage or not is absolutely none of your concern, nothing to say they have to put the rent money towards the mortgage anyway!
Your LL sounds like an absolute rogue - I feel sorry for you and hope that the LL gets everything that is coming to him.Thinking critically since 1996....0 -

Thanks. I don't think the LL realises what an impact this has on us. I'm dreading moving, scared of getting yet another landlord nightmare! I just want a quiet life

Yep, get that document filed with the court. Shelter are right, you could get AT LEAST two month's notice and you could continue renting from the bank. The bank may or may not put the property up for sale immediately. If you're still in your fixed-term that is the being between a rock and a hard place I referred to before. Still once you have a direct relationship with the bank it could be easier to see what their intentions may be. They could be willing to accept an early surrender.
Whatever happens, you must formulate a plan and have the funds at hand for your onward move, whenever that may be.0
