2nd DNA test, Mother pulled out of 1st

  • Just an update to let you know, We've still not heard anything. So we have no idea what is happening at the moment. The last phone call that took place stated we were to wait for a letter from family dispute.

    As for the can of worms etc, By all means it is for the child's benefit to prove the parent of the child. Surely the mother would put her childs best interests first and follow through first time round. Instead of creating battlefields along the way. We would like to know once and for all.

    Write to them and tell them that you will only communicate in writing in the future.
    I made the same request and as much as they dont like it they will do it. As a result I have a massive paper trail of documents, which i will never throw away.
    In fact some of the letters that I received from the csa stated that 'contact may be attempted by telephone'.
    This would have been difficult because they didnt have a firm number for me.

    My advice has always been and remains to anyone, that is anyone dealing with the csa is to NEVER deal with them on the phone.
    If they already have your number them politely decline the call, or if you can see that it is the csa ringing you then simply do not answer it.

    I also made sure that if i received a letter from them, I tried to reply promptly. Everything that I sent to them, every single letter, completed form, or whatever was sent to them using recorded delivery so that they couldnt say that they did not receive.
    It cost a bit more but was more than worth it in the end.

    Please take it from someone who has been through the csa mill.

    If a man does take the test and the mother doesn't get the child's done but it all gets raised again later, can the man insist that he is given confirmation that the child's dna has been taken before he does his test again?
  • woody - when my ex denied paternity, they were on the phone to me within a week and a letter went out to me the same day they phoned. Please don't miss the opportunity for testing by not keeping on top of this - I am broadly in agreement that things should be done via mail but it's been Xmas, more mail around than usual, staff taking time off etc. etc. etc. so there is just that opportunity for it all to go more wrong than usual. Phone them. Ask what his happening because you want to take the DNA test and get this sorted. You can back up the discussion with a letter once you've had it. Make it clear you were told you'd receive paperwork and you haven't. My concern is that if you miss the window of opportunity, even if it's not your fault, the opportunity to have the test will be denied and you're paying maintenance regardless. Don't let this happen!

    Fair point in this situation, especially if time is of the essence.
    Please dont forget the backup letter to them though, by recorded delivery of course

  • time is of the essence, yes. There's a 14 day window of opportunity to receive and return paperwork for DNA testing. If it goes astray, a decision of 'assumed paternity' will be made and that's it. Or at least that's what they say...

    I was asked earlier on to keep you updated; So here it is....

    The childs mother dropped the claim again. Through xmas & New year we heard nothing. I won't go into too much detail but the stress it placed us under caused personal heartache in a different way. I will pay that price for a long time to come.

    The point is, we recieved a letter 20th January, Saying case closed again. Reasons due to mother cancelling the claim on 1st December; How this is possible I just dn't know. Considering they didn;t call till after this date to say it had been opened.

    So hey, yet again we still don't know the truth. I'm furious & relieved at the same time.

    How can she do this to her child, If she is so sure it's my Husbands?
    Why would she cancel if she is so sure?

    Big question now is can it be opened a third time around?????

  • This is ridiculous. If men only get one chance to dispute paternity before it is assumed, so should the woman!

    This will be the date that she put in her application - if the PWC withdraws the case before the maintenance amount has been calculated then the withdrawal date is the case start date.

    To answer whether she can open another case, the simple answer is yes.

    To people saying that the NRP only gets one chance to deny paternity, this is true, one time per case - this PWC has opened separate cases.
