Police reprimands - can they be removed?

Hi there, I received a police reprimand for using 'offensive language or behaviour' in public when I was 17. I was led to believe that this would be deleted from record when 5 years had passed.

However, I'm now nearly 25, Ive never been involved in any other kind of trouble, and yet it still shows up on enhanced CRB checks.

Is there anything that I can do to get this deleted, or will I be stuck with this blemish forevermore?

    A conviction is spent after a fixed period of time, a reprimand or caution is for life, that is why you should never accept one and take your chances in court.

    Not on an enhanced CRB it isn't! A conviction is also on there for life.

    Incorrect. A caution or reprimand is immediately spent under the Rehabilitation of Offenders Act. Although, if the employer is exempt from the Act or asks if you have ever been arrested you should declare it. If the employer asks "do you have a criminal record" in regards to a reprimand or caution you may answer no. You cannot have it deleted unless it was inputted in error (namely an error of law - i.e. wrongful arrest). It will be stepped down after 5/10 years but will be viewable on the PNC until you reach the age of 100. On the old weeding system it was deleted after 5/10 years but that system was changed after 2007/8.

    A conviction is also on a standard disclosure for life as is a reprimand and caution.

    As it's a youth reporimand then it should have no bearing on adult employment.... that said if it shows up on A CRB check that is hardly a help! Employers are unlikey to understand what it means.

    This link Shows that youth reprimands are in effect "spent" immediately and should have no further bearing on your life.

    They may have a bearing depending on 1) the job being applied for and 2) the nature of the reprimand or caution. This area can be troublesome as some many people do not understand the system including many HR advisors and government websites.

    Absolutely - sex offences being one, and I know that violence is frowned upon for teachers, for example.

    I agree the information is very vague. And what *should* happen is not always what *does* happen.

    I too would be very reluctant to ever advise anyone to accept a caution. It's not the get out of jail card it if often touted to be, and I make this plain to people when explaining the process to them.

    Good to hear, though, for many who are guilty a police caution is a good thing. Moreover, it can save money - the intention.

    Mad, I was given a breach of the peace order in court when I was 19 (relating to an incident when I was 18) - which basically involved me admitting (in a magistrates court) I had breached the peace, and complying with a 6 month order that I would not do it again tut tut.

    A few years back, I had an Enhanced CRB, and to my surprise, nothing came up at all. That is rediculous how a caution can affect your CRB, and a court-order does not affect mine for similar offences...

    I guess it's just another failing of our so-called "justice" system - the missus is a barrister and she thinks many elements of the current system are a joke in general too.

    MattLFC, A breach of the peace is not a caution or a conviction. It is civil proceedings brought against you - people generally admit it and are bound over to keep the peace for a certain sum of money for a certain length of time.

    That is why it does not appear on a CRB check. It is not a failing of the CJS, but a failing of your understanding of what happened in court that day.
