Should you accept the first PPI compensation offer from a bank or credi card company?

  • Hi all, this is my first post, so please be gentle :-)

    I have been successful before in claiming PPI for RBS loans and packaged account fees
    .
    I didn't think I had anything to receive from credit cards, but as the 29th August deadline was approaching, I ended up claiming via a 3rd party (i know that was a mistake)

    After several weeks I received today an offer from RBS for 1 out of 2 credit cards. They basically forgot one of the credit cards.

    Back in 2003, I requested 2 credit cards from RBS, 1 VISA and the other Mastercard.

    The terms and conditions were the same in both cards, and the spending, pretty much the same in both cards as well.

    In their offer letter they only give a breakdown for one of the cards.

    What shall I do? just call them and mention the 2nd credit card and ask them to re-calculate?

    If there were two cards then that would be two separate complaints. You've only (so far) received the result of one.

    If your original complaint detailed two cards then it should already be treated as two separate complaints and the result of your other complaint should be pending shortly.

    However, given the deadline is so close, I'd very definitely check with the Bank to see if the other card PPI is already being looked at.

    You might want to check the original acknowledgement the Bank sent, it should have two complaint reference numbers. Your third party representatives should also be aware whether there are two complaints...
  • In previous correspondence, the bank never mentioned credit card numbers. Just a claim number. I wonder if they have just missed out the 2nd card?

    For the offer I received today, I will obviously need to pay the 3rd party commission.

    If I call the bank tomorrow and start a separate claim for the 2nd card, am I still liable to pay commission on it for the 3rd party? The 3rd party emailed me today and are aware of today’s offer

    If it’s not been addressed, you won’t need to pay the CMC for a complaint you make yourself.

    You’ll also see how easy it all is and wonder what exactly you’ve just paid them for.

    Assuming you've already signed a legally-binding contract with this company allowing them to represent you in all PPI complaints, then the answer is that you'll have to pay them for this second card too. The Bank will inform the Company of any success you have alone because they've already been sent a signed Letter Of Authority (LOA) making them legally your representatives.

    Just as an aside, is it the Bank who have "forgotten" the second card or is it you?
  • When the claim was started by the 3rd party, no credit card numbers were supplied, so I am assuming the bank made a "blind" search but ended up finding one card only. To be perfectly honest, I used the 3rd party because I didn't think I had any PPI left, after Loan PPI received in 2011 and Packaged account fees in 2014/15.

    I phoned RBS this morning and provided them with missing card number. I was told a new claim would be recorded/started.

    One of the reasons for the bank not finding one of the cards, could be my surname. On the card that PPI was found, my 2 surnames have a space in between. On the missing card, there's no space in between surnames....just a wild guess.

    The person I spoke with this morning in RBS, told me that as this is a new claim, the 3rd party doesn't need to be involved, and therefore no commission to be paid, however I think you are right, as i signed the letter of authority.

    On this note, please let me ask you a last question: I didn't actually sign any letter of authority (paper copy). I only signed a pop up advert on Facebook with my finger. Does it have the same legal value as a paper copy?

    The 3rd party keeps sending me the actual paperwork to sign, but I never did.

    In answer to your question yes it is legally binding.
