ps3 scratching games - refund?

hi,

bought my brother a ps3 for his birthday a few weeks ago, as well as two games.

ps3 from sainsbury's
game one from game
game two from argos

one of the games kept freezing up until last night when it wouldnt load at all - at first thought it was the game itself at fault but now the second game has done the same thing.

upon looking both games as scratched badly (one more so than the other) and ive just tried it with a blank disk and the same thing has happened to that so obviously the ps3 is at fault.

a quick google shows that this isnt an isolated or strange thing to have happened so ill have no problem obtaining a replacement from sainsburys.

my question is whether sainsburys have to replace the games damaged by the ps3, or the other retailers do?

is there a legal obligation for sainsbury's to do this?
do the other retailers have to replace them at all or do i have to walk away from £85 and buy them again due to the faulty equipment?

    Sainsbury. Basically the goods didnt conform to contract and as such, you'd be looking to recover quantifiable loss (as a result of the goods not conforming) from the person you had the contract with - the retailer.

    Although Sainsbury may want to send the ps3 away to be checked before they issue a refund or replacement.

    Its up to them to prove the fault isnt inherent and not the other way around.

    It may be worthwhile taking your receipts for the games along with you to give evidence for the date they were purchased and also what price was paid.

    I agree, I am not sure what the OP was thinking in suggesting such a thing.

    I would have thought Sainsbury's will sort this quite easily, although in a day you may be a bit on the hopeful side!
    Thinking critically since 1996....
