I sold my car on ebay 'Sold as seen'

I have just sold my car on ebay and the buyer clicked 'Buy it now'. the turned up next day to collect/pay, but insisted on test driving and looking over the car for around 2hours or so. It was a bit inconvenient but to be fair I would have done the same, even though I would have come and looked/test driven before committing to buy by clicking 'Buy It Now'.
I had described all/ any faults that I was aware of in my ebay listing and showed them to him when he came. On test drive the ABS light came on a couple of times, which had not happened before. The Cruise control did not work....which on looking in the car handbook with the buyer turns out to be what happens automatically when the ABS activates. He then went on to say that this could be just a sensor or something much worse, so I said several times to him that if he was unsure then I would understand if he did not want to buy the car.
Any way, he then renegotiated the selling price with me although committing to by at the 'Buy it Now' price, which in view of the ABS light coming on and the cruise control deactivation I agreed to reduce the price.
The car was registered to me at my address (my own car) and I gave him a receipt for the sale clearly stating the details of the car including the reg number, the amount and put 'Sold as Seen' - Today he rang me demanding a full refund as apparently he or his friend (who also rang and texted me) have found some faults apparently after having it in his friends garage/ workshop.
As far as I am concerned I do not have to refund his money, and to be honest I am not sure if they have not done something to the car since collecting it and driving it home yesterday.......I even let him park his old car at my house and then collected him from the local town railway station after 10pm last night when he came back to collect his old car!!!!!..he did not say anything then!
I did my ebay listing in turbo lister and then duplicated it, listing one asa 28day classified ad and at the same time listed it as a 5 day auction aswell. On my 28day classified ad it states 'No returns' but for some reason (although it was a duplicated ad!) in the returns section on the auction listing it states returns accepted............!!!?????
They are saying now that I have to refund their money and take the 'apparently' faulty car back or they will contact the police.
I have told them to do so if they feel the need but the car was sold at a reduced price than originally agreed and the receipt states 'Sold as Seen' quite clearly......we both have a copy of the receipt which details my name and address & his name and address the car make model, and reg number, date sold and total paid.... and we both signed it.
Where do I stand????? don't need this stress at Christmas

  • Seeing as you forgot to change the bit that says on the listing 'returns accepted' you have to choice but to accept that, as long as he hasn't taken anything out, he is entitled to a refund

    Right, if the buyer negotiated a new price, this was a new contract and dispensed with the old one, If he starts with e.bay, just file he has not paid for the vehicle at the sale price as per e.bay, which is true, he paid in a new contract outside of e.bay in a new private sale having rejected the terms on e.bay and refusing to pay the contracted rate.
    dont do anything, dont leave feedback and if he files dispute leave a unpaid strike.
    when he argues tell him that when he decided not to honour the price he contracted to with E.bay he broke that contract, you then allowed him to negotiate a new contract outside of e.bay and issued a new contract which he signed.
    When he pays the E.bay price, you will remove the unpaid item strike and give him his e.bay rights

  • I have been on live chat with ebay and also reviewed by turbo lister ad details and in the returns policy bit it states 'Not Specified, Click edit to add this option' but when it was uploaded to ebay it miraculously changed to say 'Returns Accepted' which I would never have put anyway.
    I am not going to refund or accept any returns as I believe that I am not obliged by law as a private seller and the fact that he renegotiated the price and signed a receipt clearly stating 'Sold as Seen'.
    Also how do I know that they are not scamming me or have interfered with the car in anyway, or even that there is any other faults than those discussed and allowed for in the sale anyway.
    I am also quite concerned as he has obviously given my details (name , personal number etc) to 'his friend' who rang me threatening me that he will go to the police.........is he allowed to share my telephone number and details with out my consent?
  • He inspected the car for two hours which is plenty of time to spot any problems, he found a couple of issues and renegotiated the price based on them. Tell him to go to the police and that he'll more than likely hear the words 'sorry, we can't help. It's a civil issue'; which it is as it isn't a crime to refuse to give somebody their money back.

    He had more than ample time to inspect, as another poster says the original contract was dispensed with and a new one agreed. Even if they do call the police they'd only be told it was a civil matter so I wouldn't be concerned about that.

    It's a civil matter not criminal but if he continues to harass you then you can report hm to the police.

    If threats are made for a refund it could be deemed to be an offence by way of 'demanding money by menaces' which the police should act upon. Lets hope it doesn't come to that all.

    Offer him £50 a month, Say you sold the car to pay some bills and no longer have any money left to refund them.
