Hi all,
had the appointment around 10ish today, clerk was quite nice chap, he asked if we had been bankrupt before and my wife said yes 5 years ago just last month and he smiled and said that’s over the 5 years. He double checked the forms and was really nice, said to come back in an hour and the judge will see us. We decided to go home because my wife was very upset. We came back and waited 5 mins to see the judge, at this point I was thinking oh my lord what is this going to be like. We were showed to the judges room by the clerk, we sat down to the side of the judge and he said I’m sorry it has come to this for you, at this point my wife got upset and was quite emotional, the judge said because my wife debt was under 6K that have we not thought of an administration order, we said no, the place we got advice from did not inform us of this. My wife continued to cry, it was very emotional, intense time, the judge kept saying sorry, I can see how distressing this is for you and that you will probably want to get bankrupt and get it over and done with, and said that he has made us bankrupt and signed the form, he wished us well and said to go the room we were in this morning. We went there, the same clerk said there you go all done; the OR will give you a ring in 2 days and arrange an interview over the phone. I double checked the actual interview was going to be over the phone and he said yes. When the OR rings we are going to request a face to face as it will be better so we can explain our circumstances and hopefully put our points across to keep our car which is valued at £1000.
To summarise, today was very stressful leading up (well I was) my wife was ok. When we were there everything was as smooth as it could b but a very emotional time, and there were no questions or anything like that, very straight forward, very nice clerks and judge.
Thanks to everyone who has offered support and advice to us, it is greatly appreciated.

When you speak to the OR's office, mention the late stage of pregnancy. They may decide to only interview one of you rather than both (your wife's debt being £6k may also mean that they don't want to interview her anyway).0 -

In a strange way we are looking forward to speak to the OR to finally get it over with to see what we will be allowed each month. Ive used the IPA calculator using my wage £25k and wifes £8k and looks like we will have money left over which i assume the OR will take this per month for a period of 3 years.0 -

The OR rang today to ask a couple of questions and made an appointment for the middle of January. I have to say the lady was very nice and understood our worries about the car being taken. She said that if the car is of the value that was on the SOA form (£1K) then she will exempt it from the bankruptcy, I stated to the OR that I got it valued on the internet and it came in just short of £1k. Needless to say we are very happy with that.0

Had a knock on the door today, took my 2 years daughter to the door, thourght it was a creditor so was going to tell them that we went backrupt this week. THe chap said you know who i am, you owe me money, it was the husband of our previous landlord came around threating us, and demanded we pay the money we owe them. He even requested the keys to our car, to which my response was no. He stated that he knows which is our car, pointed it out and said he is going to smash it up tonight. I stated that the OR will be in touch and will arrange the specific amount to be paid to his wife, he said you will make sure we dont get anything as i spent a alot of money taking you both to court. He stated that he will get an attachement of earnings and will send around the baliffs again. Also before he left he stated that i will pay the money or i will end up in A&E and also stated that he will continue to track us down like he has done and also will come back in 6 years and raise it again through the courts.
Needless to say I was glad my wife was in the bathroom as she would have lodged her high heel where the sun doesnt shine, even though due to give birth in 4 weeks. The cheeky begger even said you shouldnt be bringing a child into the world when going bankrupt.
I emmediatley reported this to the police, they came out and stated they will contact the landlord and state this is harrassement and it must stop or it will be taken further should he come to the house again.
Just when we thorght things were going to change, this happens, typical.0
