Hello every one my partner is now 60 and a few month, her work with Denbighshire council is looking shakey, would she still be intitled to redundancy as she would like to work untle 63 or 64 I have tried scearching the net but you get side tracked by clicking links and then get lot I would love to know the answer if for no other reason to stop her repeating the same thing over and over. Thanks

Depends how long she has worked there. I believe that anyone is entitled to redundancy pay if they've worked for 2 years continuously. Yes, she is still entitled to redundancy. But if she has substantial council service there can be other options, some of them better! She may be able to draw down additional pension benefits by volunteering either for retirmenet or even for redundancy (in which case she could get both!). If her pension is worth taking, it may be best to discuss her options with the union if she has one, or her pension scheme advisors. There could be benfits from volunteering rtaher than waiting to be pushed.0

Thank you very much for your help, my partner has 22 years with the council as a part time worker she works 22 hours per week why we think the job is ending is because the council is handing all of the care clients over to the private sector.0

My understanding is that since changes in the retirement age workers over 60 have the same rights as anyone else-and that includes redundancy payments0

Then depending on the circumstances she might be expected to transfer with them, rather than be made redundant. It is not a choice she will have - she needs to find out what the employer's plans are, rather than just assume she will be made redundant if the clients transfer.0 -

I agree. But equally, it would appear that she has a lot of service under her belt and is in a lower paid job (which are often most at risk of changed conditions of service after a TUPE). I would definitely advise talking to her union and/or pension provider about her options. She may well be able to volunteer for redundancy if the employer is looking for volunteers and still take her pension; she may decide to exercise her option to retire and then seek other work if she wants to continue doing something part-time... If her employment is TUPE'd there is a genuine risk of cuts in pay or conditions that could damage her pension position, and nobody can promise that won't happen three or more years down the line with another employer.0
