Bought a horsebox with credit card, need to return it!
Don't know if this is the right part of nthe forum, I hope you can give some advice.
Short story. Bought a horse box for with a credit card last week. Drove it home, not too bad, bit smelly. Started it up this morning and the cab filled completely with smoke/fumes. The vehicle was sold as being 100%, it is not!
What rights do I have to return it.
I have been on to the seller who is trying to fob me off with sending a mechanic round. We do not want the box and want to return it, it is not as described.
Grateful for any advice.

Caveat emptor. Did you get a full independent inpection of the vehicle before you bought it?
If you wanted one that is 100%, you should have gone to an official dealer and bought new; then you'd have had a warranty.
What would you be thinking if you had just sold a second hand horse box and now the punter has had the opportunity to shift his horse, wanted to return it for a full refund???
Pop the knackered back one on ebay and see if you can get some other mug to buy it. Who knows, you might even turn a profit ... ?"Now to trolling as a concept. .... As you paid by card I'm assuming it was a dealer so go back and ask them to fix. (The fault wasn't present when you left their place and on the drive home, so could be a very simple fix).0

Presumably, if you paid by credit card, then you bought it off a dealer.
If so, then you have a claim against them under the Sale of Goods Act. But I think you have to allow them to attempt to fix the problem first. Only if they can't repair it can you claim your money back.

You have no rights to return it at the moment. If you bought it private you have no rights. If you bought it from a business, you have to give them the opportunity to fix it. Chances are it is just the exhaust needs replacing. You are not being "fobbed off" with the mechanic being sent round, he is fulfilling his obligations under SOGA.
Just out of interest, when did you pass your driving test? If you passed it after 1/1/1997 and it is a 7.5 tonner you need to take at least a Category C1 LGV driving test as you won't be covered to drive it on your licence.0
