Royal Mail closing case for Item not received

OK but of a long story but here goes.

I purchased a USB drive from a company who then sent me another drive but charged me for the more expensive one I originally ordered. I emailed them and was told to return the drive. I posted it recorded but it failed to be delivered (well this is what the online traker is saying) I emailed the company about it and they asked for the tracking number. Obviously this shows as not delivered so they believe that I have not sent it and that I am just trying to defraud them, so it became harder to get a reply from further emails to them.

I subsequently failed a claim with Royal Mail who then sent the company a letter asking for confirmation that they have not received my USB drive.
The company have just ignored the letter. They have nothing to gain by answering this as
A: They have received the USB drive and they don't have to give me a refund for it.

B: They haven't received the USB drive and think I'm trying to rip them off!

Royal Mail have thus written to me informing me that as they company have not replied to their letter they have to assume that the USB drive was received by them and they will close the case in 5 days unless I can make the company reply to Royal Mail.

How can Royal Mail assume that the Parcel must have been delivered! Especially when it says it hasn't on their site. Futhermore how can I force the company to reply to them. The company are just ignoring my emails and short of going around there with a shotgun I can't make them reply to any Royal Mail letter.

What can I do? I would have taken the company to the small claims court had I had the proof of delivery. But I believe that Royal Mail are being totally unfair in assuming something showing as not delivered has been delivered.
I will of course write to Royal Mail to dispute them closing the case, however what else can I do if they refuse to keep the case open or compensate me the £32 I'm owed? :mad:
Any ideas anyone?

    Get in touch with Postwatch. The fact that the RM cannot track the item to delivered is good enough to prove your case.

    Royal Mail are beginning to try it on a bit with some of their services, don't let them get way with it.
