Faulty Motorcycle battery

Hi All,
after some advise here.
just over a year ago I purchased a new battery via a trader on... ebay.
Unfortunately after 1 year of use on a motorcycle that is used daily and has no other electrical faults the battery is now kaput.

For those who want to know more here it's a Numax YT12-A sealed gel battery.
I've charged the battery then left it standing on the worktop (in the house) no connected to anything and in a few hours it dropped 1v meaning that there is not enough voltage to start the bike.
I've tried all the usuall methods to get it replaced or refunded as clearly this didnt comply with the sale of goods act where the average lifespan for a motorcycle batter is 3 years and often lasts much longer.
Ebay helpful solution - call the police, meaning that they want nothing to do with it and are allowing a trader to ignore the uk laws.
Paypal - again dont care for the situation and said you only have 45 days to do anything.
The seller directly - wont even acknowledge my messages to them.

I'd like to know where i can go next?
Shall i contact trading standards or prehaps a solistor and them them to persue a claim againt them in the courts (battery plus the parts that now need replacing due to additional wear caused by the need for the bike to be used).

    Simply serve papers under the small claims procedure, but it cost you to apply - if it is more than a bike battery costs you could be throwing good money after bad.

    BTW a friend put a new battery on his bike in June ready for his bike trip - last week it failed in Nepal and he needed a new one, so your 3 year claim may not stand up to scrutiny.

    Numax are reasonable batteries.

    However, the problem with buying on ebay is that its hard to enforce your rights. Or even know if the battery is a genuine numax [it could be some cheap copy which fails within 6 months!]. Or whether the stock is ancient. Or used batteries they're recycling from a scrapyard! Or that that organisation you're buying from are offical Numax dealers.

    Battery will have a manufacture date and/or serial number, the manufacturer should then honour their warranty period.

    The chances are, the trader you purchased from was in fact a "drop shipper".... This mean he holds NO stock of ANYTHING and simply passes your order to the distributor or manufacturer for direct shipment to you, then take 10% off the top.

    I've bought from "drop shippers" before now and have been sent several items instead of just the one.... I contact them back to tell them and they say "my supplier says keep the items".

    Sorry but this isn't Lake Wobegon. If the average battery life is three years, half of them failed in less than that time. I don't see you can argue that any battery that fails below the average lifetime should be replaced under warranty.

    What's the statutory warranty period (No idea but probably 12 months?) What warranty did the supplier offer?

    Numax have a one year guarentee normally.
    It's also very hard to prove they haven't been abused, particually as it doesn't cover,
    sulphation, deep cycling, or overcharging, among others.

    Dropped 1v, But what did it drop after that?

    When charged you will initially get a high reading which will drop quite quickly then stabilise.

    Personally for the price of a battery i would grumble and buy from elsewhere next time.
