    How sad a world we would live in if theft was ok but only if the other person was richer than you. Imagine having your car stolen only to be told by the police no crime has been committed because your bank balance is enough to buy a new one.

    If you want to be a thief then at least be honest about it, don't try and put on some sort of Robin Hood persona to justify it.

    Anyway to the OP; if you go back to Tesco to inform them that the package wasn't as expected do you not think they'll ask what was in the package instead and want it back? I don't really see how you can avoid returning this.

    I appreciate your sentiment! You'll have to take my word for it. At the time I was working in central Liverpool and read the local press. I stopped working in Liverpool in about 2005, it was probably about 2003 that the story occurred.

    In my university days I was a law student, so the case piqued my interest, as it seemed to contradict my usual understanding that advertised prices mean nothing, offer and acceptance at the till is the contract.

    I've mentioned this case on another forum about a year ago, and got a similar response, so your scepticism doesn't surprise me. I can guarantee that it is factually accurate, but having spent time last year trying to trawl through the Liverpool Echo's online archive I didn't come up with a source I could refer you to. If you don't trust me, that's fine. Its certainly not a story on the lines of "my mate told me about a man in a store somewhere when...."

    You may be right. The point of law here might be the "legally theirs" though. I might argue that they have given away the title to the goods by handing them over to me in the shop, and therefore if the goods are not theirs, then they are mine! I need to research the concept of "unjust enrichment" a little more I think.

    And you may be interpreting my moral compass incorrectly. As I pointed out, my wife and I have different views on the matter. I'll leave it to you to determine what you think my view might be, but essentially one of us believes the goods should be returned with an explanation, and the other doesn't.

    In the absence of us agreeing, I have sought the opinions of others that either might see it from a different perspective, or give me some gauge as to how the the proverbial man on the clapham omnibus might see it.

    OP what will you do if Tesco realise that you have taken delivery of the item and send you an invoice requesting the money back, are you happy to pay it?

    Putting morals and legal issues aside, I don't think that issue will present itself. As I said, when we turned up in good faith to pick up our order, we just gave our name and said there should be one box. They got it, handed it over and off we went.

    The next time I visit Tescos I could repeat the same - "find a parcel for Mr X, just one item. Here is the order number if you want it?" I'm almost 100% certain that their systems won't have any recollection that I picked up something on that order number yesterday.

    But as I say, that is putting the moral and legal issues to one side...

    So you are taking advantage of their lax system, but what if the tables were turned and you turned up looking for an expected item only to be told that it had already been collected. Would you come on here complaining about Tescos poor service and how they say you have collected something when you have not collected it.

    The may be operating a poor system for collections in your store, but remember that can work both ways. I for one would be reluctant to order any more items through that system as they could just as easily lose my item and it would be my word against theirs that I had not picked it up as there is no cross check.

    I think we've clearly established that in my house one of us is corrupt and evil, and the other matches the moral tone of the general population of MSE's forums.

    How do I break that news to her?? :D

    I think you'll find the morality varies widely between some MSE forums. Try Grabbit for example, there you find people who live in the real world! (well some of them!!)
