moorcroft debt recovery -pre court division

Just as my son has come to facing his debts and got himself a job. Orange mobile have passed the debt onto moorcroft debt recovery.

The letter say's to pay up £299.45 to them before 8/2/07 or they will take it to court. He can't afford that all in one go. He was going to pay orange £10 a week until he had straighted other debts and then pay more when he was straight with other commitments he already has.

He paid £10 to orange yesterday - does anyone know what will happen to that payment now. and also he only owed orange £281 and they are saying he owes £299???

The letter also says he will have to pay £395 if he ignors the letter (for court fee's etc).
What should he do - any suggestion will help

  • Moorcroft are generally full of wind and will do nothing - although you have to be a bit careful or when of their "highly trained" collectors will call. In reality most of them are only one step up the evolutionary scale from plankton so a swift get lost will do the trick.

    Put your offer of £10 per week in writing, but insist on paying it by standing order. Don't give them debit card details and certainly don't accept one of their payment books as I believe that you'll pay charges at the post office.

    You could always make the offer direct to Orange and ask that they withdraw the account from Muppetcroft.

    It depends if Moorcroft are "handling" the account for Orange or if they now own the debt.

    If it is the latter, no.

    Your son should produce a Income and Expendature sheet and list all his debts and make offers ha can afford to all creditors.

    If need be - get advice from one of the freebie companies mentioned on this site

    I have a debt with Moorcroft, they charged me an admin fee or somehting. That is the reason why it is more than your son owes orange, they will set up a payment plan with your son, they insisted with me that i paid by book in the post office, yes i was charged about £1 for using the post office, i then rang moorcroft back and told them i could not afford the post office fee aswell as the debt, they agreed to me paying every month over the phone by debit card, they also sent me a statement once a month after i had made the payment showing what the balance is. Any money I had paid to the company the debt was with original was taken off the money i owed moorcroft, this was shown on my statement.

  • If Orange have sold the debt to Moorcroft, then they have to supply a copy of the deed of assignment - this is highly unlikely as mobile debt is notoriously difficult to collect. It will be on a commissin basis - i.e. for every £100 they collect they bill 10-35%. Orange will advise them of a balance adjustment in due course.
  • My OH had a mobile debt which was sold to Moorcroft, and he recieved no letters until the 'we will take you to court' letter came thru the door (due to 3 giving them the wrong address in the first place). When he recieved the letter, he phoned them, gave the correct address and agreed a payment plan with them (£50 pcm for a £370 debt, paid on the same day each month, over the phone with debit card). Despite more address hassle (how many times do you have to tell them the same thing!?!), it is now paid... Altho we are still waiting for the reciept - wonder whos house they sent that to?

    I had dealings with Moorcroft for an Orange debt, I agreed with some muppet at Moorcroft to pay it off at £40 a month direct to Orange starting at the end of December. I made the first payment then got a letter from the muppets saying that I hadn't made the payment to them as agreed blah blah blah, pay now or go to court.

    I binned the letter and then made full payment of what was outstanding to Orange and sat and waited for a letter from the muppets, and would you know it, the pre court letter came this morning!

    Phoned them up and they kindly told me that Orange had taken the debt back as of yesterday! Oh and apparently there is a letter in the post telling me this.

    Have had loads of these, in fact weekly, but threats not carried out and nobody has arrived at our house. Don't worry too much - easier said than done I know but its just scare tactics - they are bunch of idots with nothing better to do.

    i have received a letter from morecroft today - thanks to halifax chasing me for a credit card debt which may be uneforceable!

    is there any time period in which they have to produce the deed of assignment?

    If my account is in dispute with halifax are they able to send this to morecroft as all otehr attempts by varioys debt collectors seem to cease when i state that the account is in serious dispute?

    if the halifax are in breach of SAR in relation to this account could this imapct on what morecroft are doing?
