Moped accident
Hi all
This may be a long and winding one so bear with me. 18 year old son had an accident in October on his month old moped. Angry white van man cut him up and braked hard causing son to run into rear. Result - slight dent in van bumper, moped a write off, son thankfully shocked/bruised but no lasting damage. Luckily there were 2 independent witnesses who saw driver brake for no reason, driver of van was then extremely verbally abusive to son and witnesses, would not give details although son had reg no. Police/ambulance called, police took statements from all concerned and were then to follow up van driver. Have heard today that driver is being summonsed to appear for careless/inconsiderate driving plus other not driving offences in relation to this incident.
Now my question is does my sons insurance company now deal with this. He had tp&t insurance and was told by insurance co when he reported incident that unless the other driver was charged with driving offence then they couldn't do anything else as son had run into back of van. That's obviously now not the case. Now I advised him to keep a written copy of all expenses he has incurred, luckily he hadn't sold his old moped so has used that for getting to college and back but has had to re-insure that on at extra cost, buy a new helmet, pay bus fares initially after accident, make follow up phone calls to insurance co and police. Should he just call them and advise what's going on at the moment. Obviously if the other driver pleads guilty at the summons then the full court case won't be needed so at that point does sons insurance put the claim in. At the moment we don't have the other drivers name/address/insurance details, obviously police do.
Thankfully in my 25 years of driving I've never needed to do anything like this but I;m just trying to help out son to get back what he's due. (Moped was his 18th birthday present and he was absolutely devastated about the loss)
Any advice gratefully received.

Given that the driver has now been summonsed for offences I would say now is the time for the insurance company to start to proceed. Another point to remember is that the insurance claim is a civil matter and the burden of proof is a balance of probabilities, which is different to the burden of proof in the careless driving case that will be forthcoming. Point this out to the insurance company and push them to starting action sooner rather than later."You should know not to believe everything in media & polls by now !"

Just phone the insurance company and make them aware of what's been going on. They should be able to take it from there.0

You really need to be getting in touch with the driver's insurance company and lodging a claim. If your son's insurance company are dawdling (there's nothing in it for them), does he have legal expenses cover who could chase it through?0

Could always contact the van driver's insurance company and claim directly off them. Threaten that you will be going to Helphire or some other credit hire company if they don't play ball.0
