thank you digital lulu for going to so much trouble for the advice. that was a great help, and now you put it like that, cabot must have brought the debt off capial one, has i haven't had any statements from capital one for years.
here's another question if you can help again, im looking at trying to claim my credit card charges and PPI back,
i have no old account details for my cards(i no that i should of save them statements) but when supplying the natwest company my name address date of birth etc, they simply wrote back saying that tey cannot provide any details, or statements without my account number, even tho i told them already that i didnt no it!
so do you think if i contact APEX and CABOT mybe at leat one of them would have my old credit card details?
ie account number so i can get my claim going and get this debt paid off sooner,
    thanks again :)

You should ask for a copy of the account showing you owe it. I bet they have no info so how can they prove it I have included an excerpt from the Consumer Credit Act you may wish to send them in a letter. See if they can provide proof:-

    Your obligation(s):-
You must supply me with a true copy of the alleged agreement you refer to. This is my right under your obligation to supply a copy of the agreement under the legislation contained within s.78 (1) Consumer Credit Act 1974 (s.77 (1) for fixed sum credit) - your obligation also extends to providing a statement of account.

    2. A signed true copy of the deed of assignment of the above referenced agreement that you allege exists.

    3. You are notified that you are obliged to supply these documents, whether you are the original creditor or not under S189 of the CCA 1974.

Non-compliance with my request is a criminal offence under the above Act and will result in a report being submitted to the relevant statutory authorities.

As you are aware, a credit agreement that is not properly documented and signed by the customer is totally unenforceable under the CCA and therefore is a complete defence to any court claim that is issued. I shall also contest any action that was taken during that time if the agreement is not received by me.

    Hope it helps
  • cheers hancoxrg
i'll copy and paste that with the SAR that digital lulu said to try, send it off to natwest and capital one to see if i can get my old account numbers for the 2 old credit cards that i had,
then with any luck i might be able to get my claim going for PPI
    thanks for the advice :)
  • i have now found a old letter from a collection agency about my natwest debt that i owed, on it it states the long number that goes across the credit card,
if i supply this number to natwest, along with my other details, name address, DOB etc, should they now be able to supply my old credit card account details???
any help would be i great thanks
