Faulty Goods and no receipt

Hi I really hope someone can offer some advice... basically I bought a portable dvd player as a gift for someone for xmas and when they have went to use it they have said it doesn't work... I don't have the box or the receipt and when I returned it to the shop they wouldn't offer me an exchange unless I had proof of purchase... I was under the impression that if the goods were faulty and you don't have the reciept you can't have a refund but you can have an exchange... however argos have said that I need proof of purchase and without this I can't get an exchange as this is their policy... is there anything I can do?

If you bought it using a credit/debit card, you can use your statement as proof of purchase. How many surrealists does it take to change a lightbulb?

It is not unreasonable for Argos to ask for proof of purchase and as Rex says, this can be a credit or debit card statement. If you paid cash then you are in difficulties because you cannot prove you entered into a contract with them and they do not therefore have to do anything about it, even if they actually sell the item.0 -
Thanks anyway, I suppose I will have to see if somwhere can fix it instead, its just frustrating as its brand new and I feel I have wasted money on it.0

Thanks never thought of that, I'll get OH to do it just incase the recognise me0

You don't need a receipt - just proof of purchase, which can take various forms. If you don't have any proof, then the shop will not be obliged to take the item back. You could ask the manufacturer if they will swap it, but you will probablyfind yourself wasting money on the postage stamp.Don't bother trying to sue me - I've got no money!0

- You must produce your receipt
Not true - in fact the trader doesn't have to give you a receipt in the first place so it would be unfair to say that you had to produce one. However, it might not be unreasonable for the shop to want some proof of purchase, so look to see if you have a cheque stub, bank statement, credit card slip etc., and this should be sufficient.
This was taken from here http://www.detini.gov.uk/cgi-bin/get_story?fold=33&site=9&parent=107&prevpage=384&stid=161&openbus=9&golive=31-10-2003
I had the same problem with Argos, they lost as they said I had to show them the receipt. I asked them to put that in writing so I could take it to trading standards. I also argued that with the item being electrical it had a batch number and the company who made it would be able to tell when it was made, sold and who to. Needless to say I walked away with my money back.
