Joint debt with ex - help
viv.
My ex husband and I have a joint debt with Link financial. When my husband left I wrote to them and gave them his details. I asked that they chase him for a payment as well as myself. I am keeping to my agreed payment but my ex is not paying a penny. Link have written back to me saying they will not chase him because u am making a payment and as long as one of us is making a payment they will take no action.
Does anyone know where I stand with this as the debt is £27000 and I am so angry at the thought of having to pay it all back while my ex gets away with not paying a penny.
Any ideas?
The 2 other joint debts we have with other companies have contacted him and are taking a payment from both of us

The phrase they use is "jointly and severally liable."
While you might think you are responsible for 50% of the debt and your ex is responsible for the other 50%, the truth is you are both 100% responsible.
The lender will pursue you both if they can, but if not will go for the "easy prey," which by the sounds of it is you. They are not interested in what is fair, they just want their money.
When you say you are keeping to "your agreed payment" do you mean your agreement with your ex or with Link?0 -
You might be better off posting this on the Debt-free Wannabe board, there's people over there who know all about this kind of problem.

My agreement with link.
What makes me mad is that they haven't even tried to chase him!
I've posted on the debt free wannabe board before and all you ever get is judgemental rude responses to be honest!#1200 - Sealed Pot challenge £1263/£300

They wont chase him because as you say someone is paying it.
If you suddenly disappeared and they couldnt find you then they would chase him.
You are both liable for ALL the debt.
Sorrymake the most of it, we are only here for the weekend.
and we will never, ever return.0 -

It's worth checking the terms of the loan.
If it's "joint and several liability" that means that they can go after either of you for all of it. You are both liable to pay the whole sum.
So if you're paying up, they won't try to chase him, probably. You can, though....much enquiry having been made concerning a gentleman, who had quitted a company where Johnson was, and no information being obtained; at last Johnson observed, that 'he did not care to speak ill of any man behind his back, but he believed the gentleman was an attorney'.0
