Marks & Spencers refund policy on tights

I have tried to exchange an unopened pack of tights to M&S today which were a duplicated gift. I was told it was policy not to accept the return of tights or toiletries. There is no sign in the store to indicate this nor can I find any reference to this in their returns policy unless I have missed it. Does anyone have any experience of this. I am guessing there are going to be some complaints after Christmas as there will be an awful lot of people who have been bought tights which are not what they want or are the wrong size.

I bought 3 pairs of tights in M&S last week as was unsure which patterned ones would go with outfit, and checked with assistant that I could return them as she said yes as long as they were unopened. I've returned tights before to M&S with no problems. I'll try to get to shops and return the 2 other pairs tomorrow and let you know how I get on* Rainbow baby boy born 9th August 2016 *

it will be a hygiene issue the same with earrings, but if they are unopened then there should be no issue1 -

Usually it would be on the receipt (they specify 'lingerie' usually). If it doesn't mention it on the receipt and they're unopened I would definitely push to return them.1 -

bear in mind though that M&S do not, under SOGA, have to offer a refund for unwanted gifts - their policy of replacing is over and above your statuory rights.
But, if under their own terms and conditions they allow the return of unwanted goods, and do not specify exclusions, those terms were part of the original contract of sale and M&S cannot choose to modify them now.1 -

Sorry it's taken me awhile to re-post but I only got chance to return my tights today. Got a refund no problems, no questions asked. And it was a different store to where I bought them* Rainbow baby boy born 9th August 2016 *
