iPhone contract issue- also posted on phones board

My OH organised a new iPhone 18 month contract with V*daf*ne through the Carph*ne Wareh*use a few weeks ago. He organised it on the phone, ot his pac code from his current payg provider and took it into the cw, signed the paperwork & they did a credit check (their system went doen half way though so he had to go back and complete the next day) He paid £100 on his debit card for the iPhone 4s

Roll onto yesterday and his sim has still not been activated his old payg phone is still working so he called V*daf*ne to see what was happening-

They have no record of his purchase or contract from the cw. So he came home last night moaning about it and how he has to go back to the store and sort it out........ but then realised that he's bought an iPhone for £100 and could just get a sim only contract and have the phone unlocked which would work out to be alot cheaper...

So obviously there is the moral issue that the phone was that price subject to him taking out the contract i suppose?

That aside is there a time limit that the network have to action the contract within? I'm wary that if he chooses to do this they may realise and then try to bill him for line rental he hasn't used... or they may try to make the 18 month contract start at a later date when they realise their mistake tying him in for much longer


Any ideas on this would be much appreciated, It's looks like a great opportunity but really don't want to cause bigger problems

    Its not a moral issue. Its a legal one.

    Legally he has agreed to pay £100 for the iphone plus 18 monthly payments of whatever for the phone and service. Since the phone being £100 was dependent on these monthly payments then as of yet, no he doesnt have a legal right to keep the phone. The cost of the phone would be built in to the contract, as obviously a sim only with the same allowances would be much cheaper. Even if they could not legally recover the sums of the contract as no service has been provided.....they could still recover any loss they have suffered (ie the cost of the phone). As for time limits they have to do this......6 years.

    He needs to contact them and get them to sort it.

    Shouldn't it be Carphonewarehouse to speak to as they need to action the contract..
