Very disappointed with m&s marks and spencer service on wine product

  • Was it a bottle with a cork? If so it might have corked. Meaning the cork has shrunk and let air in. This makes the wine taste off . The other two bottles could be still ok.

If the wine was corked (i.e. was musty and 'off' because it was tainted by a contaminated cork) then there is no reason that other bottles would have been affected so there was no reason to return unopened bottles even if they were the same type of wine.

If, however, you simply didn't like the wine then you have no statutory rights to return anyway. Just don't buy it in future.

Either way, it was an odd decision to try to return unopened wine.

    Not really.

If there was some problem with a batch of wine (OP described it as 'sour', not corked [tasting rather like musty books smell] or having the sherry like taste of oxidised wine [air ingress]), then it's not unreasonable to suppose that other bottles will be similar.

I don't know how long this 'can't sell things that have been returned' rule has existed, nor whether it is a law or company rule, but in the past I know that wine merchants would resell returned stock - it does have a very effective tamper proof seal, after all.

I recently email Asda to ask what their policy is on corked wines and not even had a reply!

In another country I visit often, if you have a corked bottle of wine, you take it back to the store (you can only buy wine in one store in that country and not anywhere and everywhere like in this country). Even without a receipt and no matter how long ago you bought it, they will either replace or refund it. Was pretty good - 2 bottles of corked wines (bought at different times) picked two new bottles and still got 4€ back!

What I dont' understand though is taking back two unopened bottles as they might have been okay. OP what I am confused about also is was the opened bottle of wine 'off' as in corked (if it was a real cork) or was it just not to your taste?

If the latter, then I I can quite understand M&S not refunding or exchanging.
  • The wine was sour, I just couldn't get it down my mouth. That is why, I decided to return the others. But the people at the store weren't really helpful. None of them said, okay open and try the bottle, if not good, then bring it back. They just seemed adamant not to give an exchange. This post also highlights that in certain shops, service is not very good.

Surely they should treat it as if it was a product that was mouldy before expiry date. As stated before they should take the unopened wine and send it for testing because the whole batch could be off. Like the OP has continually said it didn't taste corked it tasted off. I'd try Head Office and see where you get. Good luck!
