Play.com Consumer Rights Clarification Request

Hi everyone - this is my first post here, so it's nice to be part of the MoneySaving fraternity!

My first question relates to Play.com. This morning I received through the post a DVD (£4) which I intended to give my sister as a Christmas present. However, upon discussing this with Mum it transpires we've both managed to order the exact same DVD and now have two copies! Oops.

I'm looking to return my copy. Play.com say that they will not refund my return postage costs as there is no error on their part. Instinct says "fair enough", but the MSE Consumer Rights page (sorry, can't link as I'm a newbie) suggests I should be entitled to a full refund including the cost of delivery under the Distance Selling Regulations.

Are Play.com in the right, or am I?

Any Play returns tips? I gather they can be a nightmare, and I'm not keen to spend too much on postage/phone calls/etc. granted the ruddy disc only cost £4 in the first instance!

    Play.com are not based in the UK, they are based in Jersey. Although a glance at the DSRs for Jersey suggests they may be very similar, it might be worth either reading them yourself or keeping it in mind...

    They are right, though. They don't need to refund your return postage.

    The DSR entitles you to a refund of the DVD and the postage ( although play offer free delivery) if returned within 7 days. You are responsible for the return postage!

    For a £4 DVD then I'd just add it to someone else's present. :)

Please be aware that we will not refund your return postage costs, as there is no error on our part. If you use our pre-paid postage option then we will deduct the cost from your refund.

    Please Note: Incurring postage costs will not apply if you are a returning an item of clothing or sportswear that is eligible for free returns to the UK

    Either return it or use it as a gift for someone else, maybe you and your mum should join forces and organise who gets what for the next present giving event.
  • haha, we've generally been very careful to avoid duplicates but this one slipped through the net! I'll see how much it would cost to return and if it's more than £1 or so it can be added to someone else's DVDs. Thanks everyone!
