Hi,
I left my job and now my employer is telling me I am not entitled to a P45 as I only worked part time and didn't earn enough to pay tax.
Is this true?
Can they refuse to give me a P45?
Thanks L

might be worth checking / reporting to local tax office- he may be taking off NI conts at least, from your pay, but not accounting for it..Long time away from MSE, been dealing real life stuff..

No I'm afraid he's right. If you were earning less than the threshold (I think it's about £144 a week but I may be wrong) he is not legally oblidged to give you a P45 or to register as an employer with the HMRC. Very difficult though trying to explain that to housing benefit when you lose your job and they are asking for it.0

A P45 should be issued for any employee for whom a P11 was started, and a P11 is required for any employee who earns £102 or more in any week.0

OK so I got the amount wrong. I had this problem last month and I even started a thread about it. Hubby got made redundant from a £92 a week job. Housing benefit asked for P45 and employer said he wasn't oblidged to give one as he wasn't over the threshold. Try explaining that to HB. In their world everything is black and white. So not everyone is legally entitled to a P45.0 -
I am curious. There does not seem to be any mention of an earnings limit before a P45 is needed elsewhere on the web. Surely the P45 shows your income and tax allowance. The fact you did not earn enough to pay tax would seem to be irrelevant. Some links would be appreciated.Truth always poses doubts & questions. Here's a link telling when you have to register as an employer:
http://www.hmrc.gov.uk/paye/intro/register.htm
You don't have to register if the employee is earning under the threshold for tax and NI. Therefore there is no way of getting a P45 or P60 as you will not have been entering the amounts into the HMRC website.0
