Help ballifs came, not my debt.

I have abit of a dilema.... Have just gone out to my car and found that there is a notice to seive the goods on it that has been served by the ballifs. I am not quite sure why this is here as the name on it is the lady who is registered as the previous owner and i brought the car through a main dealer.
I have phoned the number and they told me too fax over my log book to prove the car is mine, which i have done.
What I am not sure of now is, can they take my car? The car is nothing to do with the previous woman now and I have all paper work showing this.
Also where did they get my address when the address on the piece of paper is hers.

They can't take it without going to court unless they're working on behalf of a government over unpaid fines etc. Either way as you own it legitimately I can't see how they can take it.0 -
The piece of paper i have says its for unpaid road traffic fines, which were by the previous owner. I just don't understand why they have come to my home when the paper clearly has her name and address on as this is nothing to do with me. perhaps they are trying their luck ???, if you are concerned contact the police via the non-emergency number and ask their advice. At least you will then have a log of the time / date etc and they may be able to offer some better advice !

Their first thoughts might be that she has transferred the car to someone to avoid it being seized for non-payment of the fines. Threatening to seize it will bring the owner out into the open and they can then make a judgement as to whether this might be the case. That doesn't give them the power to seize the car but they can certainly ask a court to rule on the issue if they think this was a deliberate ploy. I would be surprised if you have anything to worry about but they will have seen all the tricks in the book and I think you have fallen victim to that.
Luckily you bought the car through the dealer. I hope you have kept the proof of that if they did not register the car in their own name before selling it to you.0 -

I would be surprised if this becomes a problem for you. You really can't be accused of fronting this car for her just so she can avoid the fines with the paperwork you have.
They can't just take the car as it has your name on the log book. Their only option would be to bring a court case on the basis of the fronting and your paperwork would disprove that. I really wouldn't expect them to go that far but I don't think it would be unreasonable for them to ask you to produce it to clarify the position.0 -
I have phoned the bailiff company today and it seems these people have been following me thinking that I am the other woman as she has not told them she sold the car on! I wouldnt like to hear of people following me.
Did they say anything else about the situation - ie. that they are going to drop the case with you as the car is yours and you have all the documents to prove it?Weight Loss - 102lb0 -

Best thing is not to panic
As far as I can see the car is legally yours so no worries there at all.
As far as people following you about... if you are at all concerned take their car registration number then call the police......that will certainly bring things to a head !!!!!0
