OP, are you actually reading what people are saying? there are 30 odd posts up to now laying down in plain English, your rights. You have the right to 28 days holiday including bank holidays. People are taking their time to show you your rights so please take some time to read their posts.

I have now worded a letter to HR. How should I finish this letter Dont want to be rude, just think " I look forward to hearing fom you" or "Please check this out and get back to me" does not sound right

With respect, they have not treated you badly. You have been offsick since March, and you are worried about your holiday pay?
Don't you see the inherent selfishness of your position?
No wonder employers are up in arms about the imbalance between employee and employer rights. I find it abhorrent that someone who has been off since for the best part of the year, is considering creating a commotion about the boss saying you can't carry over unused holiday pay into next year.
It is one more example of the typical Brit's chronic attitude of entitlement.

So you feel that an employer should be able to cherry pick which laws they obey and be free to disregard any they find inconvenient?
Given the publicity there has been regarding this matter it is unlikely the OP's employer is ignorant of the law (not that it is a valid excuse) so it seems they are trying to withhold her entitlement illegally. To a layman this amounts to theft.
You may not agree with this law, and you wouldn't be alone, so by all means campaign to have it changed.
What I find truly shameful and abhorrent is the way you behave on here. I can't recall you ever offering constructive advice. Generally you seem to delight in ridiculing those who are off sick and making them feel guilty for asserting their legal rights.0 -

What I find truly shameful is the notion that everyone thinks everyone owes them a living. People are so sick as to not be able to work, but not sick enough, evidently, to be thinking all the time about what else they can get from their employers.
If I was unfortunate enough to be so sick as to take a year off work, the last thing I would be worried about is losing a few days holiday. I would have proactively said to my employer: 'thanks for sticking by me during my bad time; I appreciate it. As a gesture, I'm forfeiting my holiday entitlement while I was sick. I don't see why you as a company should bear that additional financial burden.'
When I worked in London last year, we had a similar 'entitled' woman who was off sick for stress for six months. She was seemingly untouchable . . our namby pamby HR people didnt dare ask her what the problem was. She returned to work in early February 2010. Two weeks later she went on a three week holiday.
Curiously, she didnt survive the lay-offs that happened a few months later. I wonder why?0 -

As SarL said, holiday is "break from work". As awfull as it is what happened to you and everyone realises it is hard to go through illness on little money, employer has to make sure the company survives and has enough money to carry on for the sake of rest of the employees.
You've never been ill and paid your taxes, unfortunately the company is not benefiting much from that statement, it is the state that does.
I have to say I find it also weird that you get holidays while off sick, which the employer has to pay for while he also has to pay for another person to fulfill your duties etc..
However the law is that you are entitled to them, so it doesn't matter what we think.

Accruing annual leave during sick leave
A worker continues to accrue their statutory minimum holiday entitlement as normal while absent from work due to sickness. This is regardless of how long the period of sickness lasts.
Depending on the terms of their employment contract, they may also accrue any additional contractual annual leave that they would normally be entitled to.
Taking annual leave during sick leave
A worker is entitled to take statutory annual leave while on sick leave, if they wish.
Now this should mean that you can take your holidays, while off sick. Which in practice would mean that they will pay you for it - ie sick - annual leave (full payment entitlement) and then sick again. If you read on everything in that link, it should completely clarify your position.0
