it says nothing about training and leaving in 1st yr in my contract. i was not given a new contract and they just added this bit in 6 months down the line.
I forgot to mention they got us to sign the letter. i think am Fooked
so where do i stand for getting my certificates?0 -
Was it in-house training, or was it through a provider? If through a provider, you could ask them direct for them?0

Well at the time i didnt plan on leaving.
Also what do you think the best approach is regarding this matter?
Give them a call 1st thing on monday morning and say just returned to the letter and am willing to pay but unable to pay straight away but will pay installments. you think they will accept this and give me my certificates.
Also I worked for a agency and my old boss walked in regarding another matter and they got a referance from him regarding when i worked with him and they said it was really good. How would i go about obtaining a copy of this as will come in handy and speed up process regarding getting work with other companies.

You could ask the agency, rather than your old employer, for a copy of the reference your old employer gave. I agree with the previous poster that it would be a good idea to contact the course provider direct to ask for a copy of the certificates.
Are you SURE you need these certificates, though? I have 2 degrees and 3 postgraduate qualifications (all genuine, honest!), and have never been asked to prove any of these.............:DEx board guide. Signature now changed (if you know, you know).0 -

There was no course provider it was in house training from my previous company and YES i need these certificates cause in the work am in and no matter what company they all want to see ur certificates.0 -
Sounds to me like you'll have to pay up. If I recall, you left your employer without giving the correct amount of notice and doubtless they're not going to feel warm and loving towards you. That means that they will likely be as awkward as possible.
If it's an Inhouse training and they hold the certificates, you need to ask if they are willing to give you the certificates if you repay the cost of the training. Otherwise you might end up paying, but the certificates never actually materialise for you!0 -

They cannot IMHO change the contract retrospectively
Since you have not told us how much money is at stake, only you can calculate whether it is worth your time (and possibly your money) to go see an advice centre or solicitor about this. Only you can calculate how much energy it is worth giving to pursue the matter.
Keep copies of contracts you sign - it does seem a bit counter-productive that you have left less than a month before your year is up!

I think you should contact ACAS. have a copy of the contract you signed and a copy of the sheet you agreed to stating the change in terms regarding training.
The Transfer of an undertakings (TUPE) regulations prevent changes in contracts unless they are “economic, technical or organisational" now the returning of the cost of training doesn't fit in to any of the above so they changed your contract illegally, after a period of time passed it can be acceptable to make contract changes there is no specific period but 9 days later is not acceptable. They may come back with the excuse that they are bringing you in to line with the other employees of the new company, again this isn't legal. I think you have a good case.
I'm no solicitor but I take things like this as need to know information as it has affected me in the past so I read up on them. check this PDF out if your unsure.
As for the certificates I think you could have a problem, who paid for them? they normally belong to the person that paid for them not the name written on them. I sat MCP courses, did the exams and passed. all at the expense of company 1, company 2 bought part of company 1 9 months after. I asked for my certificates and was refused as they had paid for everything to do with them and said they belonged to company 1. company 2 made me redundant 6 months later (my TUPE case) hey I now need my MCP certificates to go get another job. I decided to go self employed so never needed them but you don't really need the certificates as all MCP's are registered with Microsoft and you subscribe to maintain your status I know it sucks. so they can be traced.
Your certificates, does the work you are qualified in have a body? you know like corgi for gas fitters etc where you are registered with they should be able to either send you copies or anyone who wans to investigate the authenticity of your qualifications should be able to check them out. I have stoped paying MS for my "membership" I have no plans to work for anyone at the moment but when I do I will add trained to Microsoft standards on my CV rather than MCP they can ask me about it in the interview something to talk about rather than sitting in silence why I'm no longer holding my certificates.0
