Argos - non delivery, they want me to involve the Police .....

I placed an order for delivery with Argos. They didn't deliver on the day, so eventually I chased it up. They said that the people in the flat downstairs had signed for it. Those people appeared to be on holiday, but today I have discovered that they have actually moved out.

So I contacted Argos again today, and they tell me I have to report it to the Police as theft. Argos will contact the delivery driver. And then the Police will have to investigate it.

I don't believe my neighbours stole the stuff, I don't think they were there when Argos say the stuff was delivered.

Do I have to involve the Police, or stand my ground with Argos that they did not deliver to me?

    If I were you I'd stand my ground and tell Argos that you haven't received an item you paid for and it's up to them to sort it - I'm presuming that you hadn't given them permission to leave it elsewhere? Your contract is with them, they haven't given you your goods, so it's up to them to either deliver or refund. Were you in the whole time waiting for them or did you go out at all during the delivery slot?
    Similar thing happened with me with a hoover and a catalogue company - they said they'd left it in a secure back porch although I was in all day and no-one had been. I don't have a back porch of any sort, so it clearly went to the wrong address. It was replaced immediately and I presume that they then took it up with the delivery driver.

    Contact Argos again as tell them that as the goods that you paid for haven't arrived, you require either a full refund or for a replacment item to be sent out.
    Also inform them that you will be more than happy to supply the police with whatever information they need to help with the investigation of the theft of the goods, but as clearly stated in the SOGA, it is the retailer who is responsible for these goods until they have been safely delivered to the consumer and as such, it is the responsbility of Argos to instigate any legal action as it is their goods that are missing.

    As Argos has failed you on a delivery it is their problem.

    You are entitled to a refund
