eviction date from northern rock

hi i had an eviction date for 7th oct 2011 i had arrears of 16,000 i paid £8000 to have eviction stopped then like a fool missed my payment arrangement of £863 in november i called northern rock on 9/12/11 to ask if i could make a new arrangement and was told no they have reapplied for a new date the eviction well go ahead unless i can pay the now arrears of £9000 has any one any advise how i can stop this eviction without having to pay £9000 i will be paying £863 before end of this month and asked if i paid last months as well before end of month would they make arrangement they said no i would need to pay full balance cant believe hoe stupid i have been again please any advise would be appreciated thanks

I would pay in the instalment for november now, and also pay in the next one asap. If they do go back to court as least you can show you are upto date but you will need to possibly think about paying the money in each month early. Was there a genuine reason for the late payment, eg someone ill ??

If paying your bills on time is an issue. Maybe selling up is for the best. Very difficult to comment without knowing your full circumstances. Though seen to be struggling, will raise the issue of until the next time.0 -
Is this only your 2nd eviction date from NR, or have you previously made any applications to suspend any earlier proceedings?
I would agree with nuttyp, however if you have had many evictions and suspensions before the court may take a dim view and the payments may be wasted as the judge may just allow the eviction to go ahead in which case I would take evidence to court that you have funds to catch up in place and give a good reason why you missed the payment? You may need to review how your dealing with this if you make an arrangement in October only to not pay a month later!0 -
They are well within their rights to force possession of the property - as you have already had the original possession order suspended, with the agreement to adhere to a regular repayment schedule to clear the arrears.
You have however, failed to adhere to the arrangement - as already stated, if this arrives at another possession hearing, you need to have some pretty stong evidence and mitigating circumstances, supporting why you have again defaulted on the arrangement and missed this payment. You will also need to demonstrate that you are in a position to continue to service the mortgage, and manage repayment of arrears without further issue.
If you are unable to gather the demanded 9k, this will no doubt end up before a Judge, who when looking at the evidence may decide you are simply treading water and deferring the inevitable, or depending on your reprersentation, may be more accomodating and give direction for suspension with one more chance of maintenance.
Its serious either way - so I would suggest some legal advice on this, have a free appointment with CAB whom have duty solicitors and get some guidance on the best way of managing the situation and presenting your case.

Either this is a very temporary blip and you can see how you will pay the mortgage in January, February......
Or you have to accept that you are going to have to let this one go.
A home is where you make it. If you decide that the home is not affordable then the black mark on your credit record for a repossession will effect you getting credit in the future. Now is the time to look at your options and decide whether to fight on or take control in a different direction.
If keeping the house is beyond you: In similar situations people have decided to stop paying the mortgage and save rental deposits and 1st months rent. Then they have gone out and found a rental, possibly paying months in advance to secure a decent property if their credit is bad. Then they can move on and let the lender sell up.

Some of the arrears are secured and some unsecured can I be forced to pay the unsecured with threat of eviction not had any other eviction dates oct was 1st I never went to court to make objection or defence to first as I just didn't know what to do I will contact cab today for advice does any 1 know will I get chance to go to court and try n stop eviction or will they automatically be given an eviction date thanks to all for help nr wouldn't go for arrangement first time b 4 eviction as after looking at payslips and statements it showed I can afford to pay which is true I have just been so stupid with my money0 -
First things first.
You need to find out how much of the arrears are within the secured part of your loan. This is what they will be going on, although their T&C's will probably advise on how they allocate your payment every month.
Secondly, Take your monthly payment and multiply by 3. If you can get your arrears to below thi level then you will not be evicted. The Council of Mortgage Lenders and courts take a very dim view on a lender trying to repo a house when the arrears are less than 3 months.Debt free as of 7.20am on 31st December 2012.

Is the part thats unsecured because it was a 125% loan? If you have massive negative equity it will make a difference.

hi £7000 is secured and £2000 secured
when i paid £8000 to stop eviction in october £1500 went to the unsecured
they wanted half of total arrears first time which was £8000 ia asked if they would accept half of the secured which would have been £6500 they said no eviction would still go ahead0 -
