Is this usual - restriction on 'lopping' trees?

    I was only suggesting you were out of your depth if you were doing your own conveyancing and did not understand the intracies of this issue.

    As you now say you are using a conveyancing solicitor, my 'out of your depth' comment becomes redundant.

    So my advice in these circumstance remains: speak to your solicitor - that's what you ar paying him for.

    Well I don't know how you can arrive at the conclusion that I am out of my depth from one posting.

    I'm not a conveyancer but I'm legally qualified and practice in another area of Law. So I'm well aware of the intricacies of drafting, thank you!!!

    Sigh!

    You entire first post, asking about the meaning and implication of a restriction in the Title makes it clear that you do not fully understand.... restrictions in Titles!

    That being the case, it is rash to undertake your own conveyancing (even with the support of a bunch of amateurs on a freebie website!).

    Hence my conclusion that if you were doing your own conveyancing you would be out of your depth.

    However this is all immaterial since you have now added the information that you are not a DIY conveyancer.

    (and frankly if you have such difficulty understanding my logic and interpreting my post, then DIY conveyancing would definately be a bad idea - since much of the conveyancing process involves understanding logic and interpreting documents.)

    I know more than the average person about restrictions in titles and I haven't see anything in your responses that makes me think you're in any way qualified to answer the question or are more knowledgeable in this area.

    Which is fine .... as you say, it is a free website and not every one is an expert - although there are some knowledgeable people/people with first hand experiences on here.

    But at least most people can manage to be civil and polite and not try to belittle posters.

    Agree with TBS624, this is poor advice re. TPOs. My Council has successfully prosecuted someone for lopping down 3 protected trees - total fine of £60,000 plus the Council's costs. Our tree officer is full time, is very diligent and, along with an enforcement officer, will attend any site within 30mins if someone phones up to say unauthorised work is being carried out to a TPO tree. So, be very careful about chopping down TPOs!

  • Technically, none really. Any work to a protected tree would need consent.

    If you do this the right way there shouldn't be a problem. Contact the council and agree what needs doing. Your tree surgeon should be happy to do that for you. We got permission to prune a TPO tree, we agreed in advance what could and could not be done.

    Its quite streight forward to get work done on protected trees. I had to have a number of mature very large trees felled. you need to speak to the tree protection officer. fill a simple form incliuding a plan of the trees needing work and a proposed replanting. they do a site visit, they will either grant or not grant permission. its not a long drawn out affair. you do need a good reason for doing the work. they don't let you cut them down because you don't like them.
    don't just cut them down without consent its a stupid idea and could leave you in serious trouble.
